[Interview] Lee administration is trying to ‘bury all the new history we have learned’: Bruce Cumings

‘All the new history has been squeezed out of the toothpaste tube by a lot of courageous historians, and there is no way to get it back,’ Cumings says

Bruce Cumings is the Gustavus F. and Ann M. Swift Distinguished Service Professor in History at the University of Chicago and the author of several books, including “Korea’s Place in the Sun: A Modern History” (1997) and “North Korea: Another Country” (2004).
In an interview with The Hankyoreh conducted via email and published in the print edition of the newspaper on November 26, Cumings discussed his perspective on the issue of history textbook selection in South Korea. The growth of the issue into a controversy has largely been precipitated by the government’s attempts to revise the textbook “A Modern and Contemporary History of Korea” in collaboration with the conservative New Right organization. Textbook authors have since voiced objections to the revisions and educators and parents have voiced objections to reports that the government was trying to pressure individual principals into using the government’s preferred textbook.
Cumings is critical of the administration’s handling of the textbook selection process and was one of the people who signed a statement released November 11 by the Organization of Korean Historians with the support of 676 scholars, 562 from Korea and 114 from abroad. The statement said that the Lee Myung-bak administration’s interference with a school’s ability to choose its history textbook was political and has diminished a student’s right to an education.
The Hankyoreh: How and why did you participate in this campaign? Did you also ask other American scholars to participate in the statement?
Bruce Cumings: I think the vast majority of scholars in Korean Studies in the U.S., Korea and elsewhere think that governments have no business sticking their noses into what historians write, or what responsible authors and editors choose to include in textbooks. Any American presidential administration that did that would be seen as a laughing stock.
Q: The way the government is sticking to the issue of history textbook selection is unprecedented in modern Korean history. Since the launch of the Lee administration, the government’s intervention in the issue has become conspicuous. What do you think about this?
A: The Lee administration is living in the past, still remembering the way Park Chung-hee and Chun Doo-hwan operated. It is very anachronistic for politicians to think that they can control history, or history textbooks.
Q: Why do you think this administration is stepping up its offensive against the idea of modern history?
A: After ten years that were truly new and different in postwar Korean history, the Lee administration is trying to turn the clock back, and to deny the enormous progress that has occurred since 1997 under Kim Dae Jung and Roh Moo-hyun, in gaining a fuller understanding of postwar history, in furthering reconciliation among people in the South and with the North, and in dramatically changing the attitude of the general population in the ROK toward the North.
Q: One of the keywords they often bring up is “legitimacy.” They think that describing unpleasant events in history textbooks
could weaken the legitimacy of the regime[[[ the elements that brought about Korea's independence.]]] What is your opinion about this?
A: Legitimacy is not something to be gotten by controlling textbooks, or manufacturing an historical line. It can only come from the people, as they come to recognize the correctness and authority of a government. Instead of gaining legitimacy, the Lee administration is acting like an ostrich, sticking its head in the sand at the sound of bad historical news. Even worse, they are acting like the right-wing Japanese, trying to paper over difficult issues while claiming to protect “national pride.” The new history produced in the past 20 years in the ROK, uncovering many thorny and tragic problems, is actually the best path toward a reconciliation among people of very different perspectives and experiences in the South, between the victimizers and the victims, and has also helped the reconciliation between North and South.
Q: How does this kind of interference with history textbooks affect students?
A: Students are seekers of truth, and although they also want to be proud of their country, they have utter contempt for authorities who would deny them access to the best historical information and scholarship. When someone tries to do that, as the ROK did for many decades, the result is that young people think that everything they have heard from the authorities is a pack of lies -- and then they truly lose pride in their leaders and their country. An example is this: my friend Suh Dae-sook proved in his 1968 book that Kim Il Sung was a genuine fighter against the Japanese for a decade after the Manchurian incident, going through all kinds of trials and difficulties -- all scholars know this, and have known it at least since 1968. Yet students were told for decades that Kim was an “imposter” who stole the name of a great patriot. Here is the result: two decades later when Professor Suh delivered a lecture about Kim’s background at Seoul National University, the whole room erupted in raucous cheers! So, it is self-defeating to try to hide the truth from students. Sooner or later, it will come out.
Q: It has been almost nine months since the launch of the Lee administration. Since then, there have been some dramatic incidents such as the candlelight demonstrations. I think you have been monitoring the things Korea has undergone. How do you evaluate the Lee administration as a whole?
A: This administration has made mistake after mistake, and has gotten nothing for it. They cozied up to the Bush administration, the most unpopular in American history (and perhaps in the world), just at the point where Bush was a lame duck. They purposely alienated the North, just as Bush was turning toward engagement with Pyongyang -- and the result was, no one in Washington or in the 6-Party Talks pays much attention to Seoul’s viewpoint. They are now trying to bury all the new history we have learned about the colonial and postwar periods, and this only makes young people want to know more -- they want to know exactly what the administration is trying to cover up. All the new history has been squeezed out of the toothpaste tube by a lot of courageous historians, and there is no way to get it back into the tube. It’s as simple as that: it can never work.

Meeting Friends from the Past

Last night was rather hectic. When squeeze three appointments with people from my past into the usual tight schedule, I thought of myself what on earth I wish to see them. Some seemed appreciate that I took notice of their presence of being back to Seoul, but some not much. With one person, I almost felt humilated because he managed to have me feel as if I begged to see him. 'Interesting,' I thought. I remembered why I hadn't contacted him for last three something years, and felt I wasted my time. But the other two were great to see after lengthy years apart. Despite the short talks we have over a cup of tea, and sizzling plate of cow intestines and soju, we managed to briefly catch up with the time we hadn't exchanged one another. Great! Yet, in some conversations, I realized there were certain stuffs we no longer coincide each other; differences that I hadn't felt before came to us. a short silence and a slightly awkward jokes were exchanged.

'Is this it?,' I thought.
Life moves on, and people who I used to know seem taking a different walk of life.

Conservative March


Members of 12 different conservative organizations, including New Right Korea, march toward Seoul’s City Hall on November 24 after a press conference during which they criticized a photo exhibition organized by the Truth and Reconciliation Commission of Korea, saying the exhibition depicts policemen and soldiers as murders.
The photo exhibition was held from November 21 to 27 and displayed evidence of murders performed since after the Korean War.

전 장관은 연합뉴스와의 인터뷰에서 "오바마가 우방국들과의 동맹관계에 대해 전반적인 검토를 할 것이고 그런 과정에서 현재 2만 8천500여 명 수준의 주한미군을 더 줄일 가능성을 배제할 수 없다."라고 밝혔다. 그는 그러한 가능성의 배경으로 "오바마 당선자가 군사안보를 중시하는 20세기 냉전적 사고에서 자유로운 21세기 인물이고, 금융위기 해소를 위해 투입하기로 한 7천억 달러의 자금을 마련하려면 국방분야에서도 예산을 아낄 생각을 할 것"이라고 말했다. 한승주 전 장관은 한ㆍ미 간 현안인 FTA 비준과 관련해 "미국 의회의 한미 FTA 비준 여부와 시기는 자기들의 일정과 정치적 계산에 의해서 결정되기 때문에 우리가 먼저 비준을 하느냐 여부는 결정적인 영향을 준다고 생각하지 않는다."면서 "자동차 부문 논란을 포함한 FTA 문제에 대해 한ㆍ미 양국이 다 같이 성의와 호의를 가지고 서로 이해하면서 해결방법을 찾는 것이 최선"이라는 견해를 밝혔다. 그는 "오바마 정부의 출범과 관련해 대비나 적응은 필요하지만 우리의 외교정책, 특히 대북정책의 기조를 바꾸는 것은 가능하지도 않고 필요하지도 않다."라고 강조하고 "대북정책에서 우리 정부의 원칙은 오바마 정부와 대체로 일치하고 있어 상충할 가능성은 크지 않다고 본다."라고 덧붙였다. 다음은 인터뷰 내용. -- 오바마 정권 출범 후 한반도 정책을 포함해 어떤 변화가 예상됩니까. ▲ 국내 정책에서는 자유방임, 무제한 경쟁으로부터 복지, 평등, 환경, 교육 등을 강조하는 정책을 추구할 것입니다. 물론 금융위기라는 발등에 떨어진 불을 끄는 데 최우선적인 노력을 할 것입니다. 대외적으로는 무력을 중심으로 하는 hard power보다는 외교력, 설득력을 강조하는 soft power의 비중을 높일 것이며, 일방주의에서 다자주의를 중시하는 정책을 추구할 것으로 기대됩니다. 동맹관계를 중시하면서도 다른 주요국들과의 협조체제(concert)를 구축하는 노력도 기울일 것으로 예상합니다. 한반도 문제는 아무래도 우선순위에서 밀릴 것 같습니다. 금융문제라든지 이라크, 아프가니스탄 등 중동문제와 같은 급한 것들이 많습니다. 그러나 동맹체제에 대한 전반적인 검토가 있을 것이라고 봅니다. 과거 카터 전 대통령 때처럼 완전 철군을 하겠다는 결정은 아니겠지만 주한미군의 규모라든지 역할이라든지 이런 것에 대해서 조정이 있을 수 있습니다. 오바마는 냉전, 군사안보 우선과 같은 20세기적 생각에서 자유로운 사람입니다. 동맹이라는 게 필요하기는 하지만 국제정치로 보면 밸런스 오프 파워(Balance of Power)보다는 concert 쪽에 더 관심이 있을 가능성이 있다고 봅니다. -- 카터와 비교해 오바마의 주한미군에 대한 입장은 어떠할까요. ▲ 카터는 완전히 철수하겠다고 그랬지요. 오바마는 물론 그러지는 않을 거고요. 카터 때는 처음에 완전철수를 주장했다가 부분 철수로 수정해 6천 명인가를 감축했지요. 카터는 선거유세 때 주한미군 완전철수를 공약했습니다. 반면 오바마는 전혀 그런 건 없지요. 세계 전체적으로는 오히려 미군의 지상군을 늘려야 한다고 얘기했습니다. 늘리는 방법도 여러 가지인데 다른데 주둔하고 있는 병력을 조정하는 방법도 있습니다. -- 주한미군은 감축이나 조정은 가능하다고 보십니까. ▲ 지금 2만 8천500여 명 수준인데 더 줄일 가능성을 배제할 수 없습니다. 큰 감축은 아니겠지만요. 오바마는 21세기형 리더입니다. 아무리 주변에 옛날 사람들이 많다고 해도 새 사람들과 함께 21세기 시각에서 한국을 비롯하여 일본, 나토 등과의 동맹체제에 대해 전반적인 리뷰를 할 것으로 예상합니다. 또한, 미정부가 금융위기 해소를 인해 지원키로 한 7천억 달러는 미국의 1년 국방예산 규모입니다. 그게 전부 국방분야에서 오지는 않겠지만 좌우간 돈이 어디서 와야 될 것 아니겠어요. 그러니까 돈 세이브하는 것도 좀 생각을 해야 되겠지요. -- 대통령 한 사람에 의해 대외정책이 좌우됩니까. ▲ 아닙니다. 그러니까 카터가 주한미군을 완전히 철군하지 못했지요. 그때는 주변에 있던 사람이 전부 한국전쟁세대 사람들이고 군인들도 그렇고 참모들도 그랬는데 지금은 오바마의 참모들 자신이 전부 한국전쟁을 마치 옛날 보불전쟁처럼 생각할지도 모릅니다. 중국 외교부 대변인이 한미동맹은 냉전의 유산이라고 말하기도 했습니다. 20세기 유산인 셈인데 오마바는 21세기 사람입니다. 61년생이니까 4.19 직후지요. 한국전쟁이 끝난 지 8년 만에 태어났으니 우리식으로 하면 386세대가 되나요?-- 한미 양국정부 간 마찰을 예상합니까. ▲ 노무현 정부와 부시 정부가 좀 이념적인 데 비해 이명박 대통령과 오바마 당선자는 상당히 실용적인 경향이 있으니까 만약 다른 의견들이 있으면 대화나 조정이 될 것이라고 봅니다. -- 북한이 개방을 선택할까요. 김정일과 오바마의 만남이 이뤄질 가능성이 있다고 보시는지요. ▲ 글쎄요. 개방을 할까요? 전 개방 안 할 것 같은데요. 안 하면서 갈 데까지 가보자고 할 것 같습니다. 왜냐하면, 개방하면 뻔한 거니까요. 두 사람이 만날 가능성은 금융위기 이런 것 때문에 상당히 먼 얘기라고 봅니다. 또한, 그런 과정에서 김정일이 회복할 수 있을지도 변수이고요. 지금 나오는 사진이 옛날 사진을 합성한 것인지 알 수가 없지요. 지난번 미국에 갔더니 김정일의 건강에 대해 좀 더 심각하게 판단하는 것 같았습니다. -- 오바마는 한ㆍ미 FTA에 반대하고 있는데요. ▲ 많은 사람은 그가 FTA를 반대한 것은 선거기간 중의 표를 의식한 발언이고 결국은 FTA 지지로 돌아설 것이라는 낙관론을 펴고 있습니다. 그러나 그는 선거운동 기간 너무나 일관성 있게, 강력하게 FTA를 비판해 왔습니다. 또 그 자신이 어떤 부분, 특히 자동차 교역 부문에 불만을 가진 것으로 보입니다. 저는 한국이 1년에 70만 대를 미국에 수출하면서 5천 대만 수입하는 것은 불공평하다는 오바마의 논리가 맞지 않는다고 생각하지만 그가 너무나 여러 번 (특히 TV 토론에서) 강조했기 때문에 그냥 번복하거나 무시하지는 못할 것으로 보입니다. 문제는 지난번 FTA 협상에서 이미 미국과 한국 쌍방이 자동차 교역에 개방하고 양보할 만큼은 양보해 놓았기 때문에 그러한 불균형을 교정할 수 있는 조치가 없다는 점입니다. 결국은 오바마가 어떻게 체면을 살리면서도 FTA를 받아들여 미국의 국익에 부응토록 하느냐는 데 있다고 봅니다. 지난번 쇠고기와 관련해 미국이 자국의 이익을 희생하지 않으면서 우리에게 추가조치를 허용했던 일이 있습니다. 모든 외교와 협상에는 내용도 중요하지만 formula, 즉 방법과 모양도 중요합니다. 미국의 오바마 정부와 우리 정부가 정치적인 부담을 크게 지지 않으면서 상호 간의 이익을 추구하는 방법, 상징적으로 오바마의 정치적 체면을 살리수 있는 방법, 즉 FTA를 실시하는 방법을 찾는 것이 필요합니다. -- 국회의 FTA 비준안 연내처리가 성사에 도움될지요. ▲ 미국 의회가 연내에 한미 FTA를 비준하느냐 안 하느냐 또는 내년에 하느냐, 어느 시점에 하느냐는 결국 미 의회 일정과 자기들의 정치적 계산에 의해서 결정된다고 보고요. 우리가 먼저 비준을 하느냐 여부가 그렇게 결정적인 영향을 준다고 생각하지 않습니다. 비준을 하면 우리의 성의와 더불어 재협상이라든지 추가협상의 여지가 없다는 결의를 보여주는 효과는 있겠지만 미 의회에 영향을 준다고 보지는 않습니다. 다만, 비준 문제가 국내적으로 정치적 갈등과 균열을 가져와서 대미관계, 반미정서에 영향을 준다면 그것은 미 의회의 비준에 도움을 주지 않으면서 국내적으로 자체적인 피해를 입는 것이라고 보기 때문에 어떤 방향으로 나가든지 화합하고 합의를 거쳐 일을 처리하는 것이 좋다고 생각합니다. 여야 간 진지한 대화를 하는 것이 필요하다고 봅니다. -- 앞으로 북ㆍ미관계를 어떻게 전망하십니까. ▲ 부시 행정부가 말기에 들어서 북한과 상당히 적극적인 대화와 협상을 벌여왔습니다. 오바마 정부는 그러한 부시 말기의 정책을 계승할 가능성이 큽니다. 지금 상태로서는 부시 행정부가 시간에 쫓기다 보니 너무 북한에 양보를 많이 하고 북한에 일방적으로 유리한 협상을 해 놓았기 때문에 오바마 정부가 그것보다 더 적극적인 협상을 하기는 어렵다고 봅니다. 오히려 지금까지 해 놓은 협상 중에 미흡한 사항 (예를 들면 북의 미신고 핵 시설에 대해 사찰은 상호 합의를 거쳐야 한다는 조항) 등을 다시 짚고 넘어가야 하는 문제들이 있다고 생각합니다. 앞으로 북ㆍ미관계의 전망은 시간이 좀 지나야 드러나리라고 봅니다. 통상적으로 주요 문제에서 전임 정부의 정책을 충분히 검토(review)하기 위해서는 약 6개월은 걸리지요. 진용도 짜야 하고 내부적인 검토, 절충도 거쳐야 할 필요가 있습니다. 오바마는 시급하게 대응해야 할 사안들이 많이 있습니다. 금융위기는 물론, 이라크, 아프가니스탄, 이란, 중동문제, 러시아와의 관계 등이 그의 정책적 우선순위가 될 것입니다. 따라서 북한 문제가 당장 위기상황이 아닐 때 얼마나 높은 우선순위를 둘 것이냐에 대해 의문이 제기됩니다. -- 북한이 앞으로 '통미봉남'으로 나가지 않을까요. ▲ 북한의 목표는 미국과 관계개선이고 되도록 우리를 배제하겠다는 생각이므로 미국과의 관계가 잘 진행되고 경제적으로 지원도 받을 수 있으면 소위 '봉남'(封南)을 해 우리의 입지를 약화시키려고 할 것으로 생각합니다. 그러나 실질적으로 북한에 경제적 지원과 협조를 제공할 수 있는 나라는 한국밖에 없습니다. 북한이 이러한 사실을 알면서도 우리의 국내외적 입장을 어렵게 하려고 '봉남'을 시도할 때, 국내적으로 북한에 조건 없이, 무제한 적으로 또 상호성 없이 지원해야 한다고 정부를 공격하는 것은, 북한의 통미봉남 전략을 포기하기 어렵게 만드는 결과를 가져올 수도 있다고 생각합니다. 우리는 북한에 대해 인도주의적인 지원은 계속하면서, 정책적 지원에 대해 원칙을 세워 일관성 있는 자세를 유지할 필요가 있습니다. 미국에 대해 이러한 우리의 정책을 충분히 이해시키고 대북정책에서 확실한 공조를 취해나가는 것이 필요합니다. -- 6자 회담 구도에는 변화가 없을지요. ▲ 북한은 핵 문제를 미국과의 협상에 국한하려 합니다. 또 지금까지의 오바마 발언을 보면 6자회담보다는 북미 양자 협상에 무게를 두는 인상을 받게 됩니다. 따라서 6자회담은 북핵문제 해결에 도움을 줄 수는 있어도 그 틀 안에서 해결된다고 보기는 어려울 것입니다. 지금 상황만 놓고 보더라도 지난 10월의 북미 합의 (검증과 테러지원국 해제와 관련된 것)에 대해 일본은 부정적인 입장이고 그것을 적극적으로 지지하는 나라는 중국밖에 없는 것으로 보입니다. 북핵문제의 '해결'을 말하지만, 우리는 북핵문제를 놓고 볼 때 그것을 '해결'하는 것, 즉 북한을 완전히 비핵화, 비핵무기화하는 과제가 있습니다. 동시에 우리는 그전 단계에서 그 문제를 '관리'하는 문제가 있습니다. 그것은 북한의 핵 활동과 생산을 동결시키고, 가능하면 불능화시키고, 그와 관련된 협상의 틀을 살려 계속 비핵화를 논의하고 협상하는 것, 또 북핵문제가 무력분쟁으로 발전하지 않게 만드는 것, 이러한 조치와 활동이 북한 핵의 평화적 '관리'라고 하겠습니다. 북핵문제의 해결은 몰라도, 이러한 '관리' 차원에서는 6자회담이 필수적이라고 생각합니다. -- 오마바 정부 출범과 더불어 우리의 대미 외교전략도 총체적 점검이 필요하다고 보는데 외무장관, 주미대사를 지낸 경험에 비춰 조언해줄 것이 있다면. ▲ 외교정책, 전략은 항공모함, 또는 유조선과도 같아 다른 나라의 정권이 바뀌었다는 이유로 갑자기 방향을 바꾸거나 속도를 크게 조절할 수는 없습니다. 이번 오바마 정부는 한국으로서 커다란 조정을 할 필요는 없다고 봅니다. 한반도 정책과 관련해서는 오바마가 부시 정책을 대체로 계승할 것으로 예상합니다. 대미 관계에서 그동안 이명박 정부 출범 후 부시와 이 대통령의 개인적인 친분관계가 미국에 대한 정책에 영향을 준 것은 사실입니다. 쇠고기 추가협상을 허용한 것, BGN(미국 地名위원회)가 독도 표기를 원상 복귀해 준 것, FSM(해외군사장비판매)의 지위를 격상해 준 것, 외화 지급 보증을 위한 화폐 스와핑에 합의한 것 등은 미국의 국익을 계산한 점도 있으나 양국 정상 간 개인적인 관계가 큰 도움이 되었던 것은 사실이지요. 앞으로 오바마 정부와의 관계는 인맥도 도움되겠으나 그보다는 설득력 있는 논리와 정책, 그리고 효과적인 외교력이 더 중요하다는 것을 인식해야 합니다. 저의 경험으로 미국과의 효과적인 협의는 현실적이고 설득력 있는 정책을 두고 상대방과 브레인스토밍(brain-storming) 식의 논의를 하는 것으로 생각합니다. 상대방을 가장 잘 이해시킬 수 있는 방법은 개인적 친분관계라기보다는 정책의 합리성과 설득력입니다. 특히 오바마는 부시에 비해 더 신중하고, 계산적이며, 실용주의적일 가능성이 큽니다. 이는 곧 인맥보다는 합리성과 설득력이 더 중요하다는 것을 말하는 것이지요. -- 한국은 미국발 금융위기에 어느 나라보다도 더 큰 충격을 받고 있습니다. 이런 상황에서 '외교'가 떠맡을 역할은 무엇이라고 보십니까. ▲ 지난 1997-98년 당시의 위기 때는 외교의 역할이 상당히 컸다고 생각합니다. 그 당시는 우리가 미국의 도움을 받는 입장이었고 그를 위해 미국은 동맹국으로서, 한반도의 안보를 위해 한국을 도와줘야 한다는 점을 미국에 설득시키는 것이 중요한 과제였지요. 그러나 지금은 미국 자신이 금융 위기를 경험하고 있습니다. 지금은 우리나라가 G-20회의에 참석하게 되어 있고, 미국 등과 더불어 다자적인 차원에서 금융위기를 없애야 할 필요가 있습니다. 한국은 현재의 위기를 미국과 협력하고 미국의 도움을 받아 극복하고 미국과 상당기간 긴밀한 협조와 협의를 성립시켜야 할 것으로 생각합니다. 오바마로서 가장 부담되는 것은 세계에서 기대가 너무 크다는 점입니다. 경제, 금융위기를 해결하고, 중동문제도 해결하고, 미국의 입지를 강화시키고, 각국과의 관계도 개선하기를 바라고 있습니다. 그러나 오바마가 이러한 기대를 모두 빠른 시기에 충족시키기는 어려울 것입니다. 당연히 실망이 따를 것입니다. 특히 아시아인들이 걱정하는 것은, 그가 보호무역적인 정책 방향을 고수하고, 금융문제, 아프가니스탄, 중동 문제 등에 몰두하여 아시아에 대한 관심과 비중이 작아질 가능성 등이지요. 그가 아시아와 각별한 인연을 가졌다고 해도 때문에 다소 마찰이 생기기도 했습니다. 대중국 관계에서 미국은 역대 정권이 처음 들어서서는 갈등관계로 시작하다가 점차 관계가 좋아지는 경향을 가져 왔지요. 아버지 부시와 클린턴, 아들 부시 대통령 때도 같은 패턴이었습니다. 그러나 오바마는 그러한 전철을 밟지 않고 처음부터 중국과 실용적인 관계를 가질 것으로 예상합니다. 즉 중국을 책임 있는 이해당사국 (responsible stake-holder)이라는 전임 정부의 후기 정책을 계승할 것으로 예상합니다. 러시아와 북한에 대하여 오바마 정부는 대화와 설득, 협상을 강조하겠지만 동시에 자신이 상대국에 약하게 보이는 것을 민감하게 의식해 도전에 대해서는 강하게 나올 가능성이 큽니다. 과거 소련의 후루시쵸프는 케네디 취임 후 쿠바에 미사일을 장치함으로써 미국 정권을 테스트했고, 북한은 클린턴 취임 후 NPT(핵확산금지조약)를 탈퇴함으로써 새 정부를 시험했습니다. 그때마다 젊고 자유주의적인 신참의 미국 대통령은 강력하게 대응한 바 있습니다. 오바마는 북한과의 관계에서 인권문제를 짚고 넘어갈 것이므로 납치문제에 집착하는 일본으로서는 미국과 협조할 명분을 주는 효과가 있을 것입니다. 오바마는 지금 세계에서 군사적으로 가장 급박한 지역이 테러집단을 지원하고 훈련하는 알 카에다, 그를 지원하는 탈레반의 근거지인 아프가니스탄, 파키스탄 접경지대라고 생각하고 있습니다. 따라서 이라크에서는 철군을 추진하면서도 아프간에 대해서는 군대를 증원해야 한다는 주장까지 하고 있습니다. 그런 경우 한ㆍ미, 미ㆍ일 동맹을 강조하면서도 필요에 따라 이들 지역의 미군을 부분적으로 아프가니스탄 The Obama-Biden Plan

The US President-elect Obama and the vice-president elect Biden came up with their ideas summed up and uploaded on the website of the transitional government. On surface, I found hard to clearly distinguish differences from other promises done by his predecessors except he seems to leave the door open for commoners to join. Some points under the resolution to stop the climate changes, change Guantanamo Bay Detention Center, etc. indicated specific dates to complete tasks concerned. I wholeheartedly support those, but have to admit if fixing dates were wise thing to do, since the climate is not a subject that can be changed by any and the Guantanamo issue's been at the center of so many political/diplomatical debates over last several years. The world sees every step of their moves with hopes and also with caution such enlarged by the sad era of mistrust.

Barack Obama and Joe Biden will renew America’s security and standing in the world through a new era of American leadership. The Obama-Biden foreign policy will end the war in Iraq responsibly, finish the fight against the Taliban and al Qaeda in Afghanistan, secure nuclear weapons and loose nuclear materials from terrorists, and renew American diplomacy to support strong alliances and to seek a lasting peace in the Israeli-Palestinian conflict.
Afghanistan and Pakistan

They will increase our troop levels in Afghanistan, press our allies in NATO to do the same, and dedicate more resources to revitalize Afghanistan’s economic development. Obama and Biden will demand the Afghan government do more, including cracking down on corruption and the illicit opium trade.
Pakistan: Obama and Biden will increase nonmilitary aid to Pakistan and hold them accountable for security in the border region with Afghanistan.
Nuclear Weapons
A Record of Results: The gravest danger to the American people is the threat of a terrorist attack with a nuclear weapon and the spread of nuclear weapons to dangerous regimes. Obama has taken bipartisan action to secure nuclear weapons and materials:
He joined Senator Dick Lugar (R-In) in passing a law to help the United States and our allies detect and stop the smuggling of weapons of mass destruction throughout the world.
He joined Senator Chuck Hagel (R-Ne) to introduce a bill that seeks to prevent nuclear terrorism, reduce global nuclear arsenals, and stop the spread of nuclear weapons.
Secure Loose Nuclear Materials from Terrorists: Obama and Biden will secure all loose nuclear materials in the world within four years. While working to secure existing stockpiles of nuclear material, Obama and Biden will negotiate a verifiable global ban on the production of new nuclear weapons material. This will deny terrorists the ability to steal or buy loose nuclear materials.
Strengthen the Nuclear Non-Proliferation Treaty: Obama and Biden will crack down on nuclear proliferation by strengthening the Nuclear Non-Proliferation Treaty so that countries like North Korea and Iran that break the rules will automatically face strong international sanctions.
Move Toward a Nuclear Free World: Obama and Biden will set a goal of a world without nuclear weapons, and pursue it. Obama and Biden will always maintain a strong deterrent as long as nuclear weapons exist. But they will take several steps down the long road toward eliminating nuclear weapons. They will stop the development of new nuclear weapons; work with Russia to take U.S. and Russian ballistic missiles off hair trigger alert; seek dramatic reductions in U.S. and Russian stockpiles of nuclear weapons and material; and set a goal to expand the U.S.-Russian ban on intermediate-range missiles so that the agreement is global.
Iran
Diplomacy: Barack Obama supports tough and direct diplomacy with Iran without preconditions. Now is the time to use the power of American diplomacy to pressure Iran to stop their illicit nuclear program, support for terrorism, and threats toward Israel. Obama and Biden will offer the Iranian regime a choice. If Iran abandons its nuclear program and support for terrorism, we will offer incentives like membership in the World Trade Organization, economic investments, and a move toward normal diplomatic relations. If Iran continues its troubling behavior, we will step up our economic pressure and political isolation. In carrying out this diplomacy, we will coordinate closely with our allies and proceed with careful preparation. Seeking this kind of comprehensive settlement with Iran is our best way to make progress.
Energy Security
Achieving Energy Security: Obama will put America on a path to energy independence by investing $150 billion in renewable and alternative energy over the next ten years -- an investment that will create millions of jobs along the way. He’ll also make the U.S. a leader in the global effort to combat climate change by leading a new international global warming partnership.
Renewing American Diplomacy
Renew our Alliances: Obama and Biden will rebuild our alliances to meet the common challenges of the 21st century. America is strongest when we act alongside strong partners. Now is the time for a new era of international cooperation that strengthens old partnerships and builds new ones to confront the common challenges of the 21st century -- terrorism and nuclear weapons; climate change and poverty; genocide and disease.
Talk to our Foes and Friends: Obama and Biden will pursue tough, direct diplomacy without preconditions with all nations, friend and foe. They will do the careful preparation necessary, but will signal that America is ready to come to the table and is willing to lead. And if America is willing to come to the table, the world will be more willing to rally behind American leadership to deal with challenges like confronting terrorism and Iran and North Korea's nuclear programs.
Israeli-Palestinian Conflict: Obama and Biden will make progress on the Israeli-Palestinian conflict a key diplomatic priority from day one. They will make a sustained push -- working with Israelis and Palestinians -- to achieve the goal of two states, a Jewish state in Israel and a Palestinian state, living side by side in peace and security.

Engaging the American People on Foreign Policy: Obama and Biden will bring foreign policy decisions directly to the people by requiring their national security officials to have periodic national broadband town hall meetings to discuss foreign policy. Survey Methodologies to Investigate the Massacred Civilian Victims

This project is to survey on the scale of civilian victims of the mass killings taken place during the Korean War and has been proceeded collaborating with outsourced research teams. In 2007, Seokdang Research Institute of Dong-ah University carried out the survey project of the massacred civilian victims in regions such as Gimhae-si, Cheongdo-gun, Gurye-gun, Youngam-gun, Gochang-gun, Gongju-si, Cheongwon-gun, Ganghwa-gun, etc. The selected regions were chosen after carefully speculating the scale and the representative-ness of each mass killing. Particularly, Ganghwa-gun was included because it was a military borderline of the two conflicting powers then, and Gimhae was significant because a large number of mass killings against civilians were occurred even though the region was never taken by the North.

In 2008, Jeonnam University supervised a research project over regions such as Hamyang-gun, Youngcheon-si, Younggwang-gun, Imsil-gun, Youngdong-gun, Inje-gun, etc. One of the commonly used research methodologies was a group interview throughout field researches, and recording and documentation of testimonies from the victims. Individual cases are investigated particularly focused on an outline, a type of damage, a category of perpetrators, and surrounding circumstances of each incident. Then investigated results were then categorized by each geographical denomination, and this statistics became a source of viewing the data in accordance with each region of the country. These collected data, then had to go through an extensive screening test to determine the truthfulness. And the final stage was to reconstruct the categorized groups into other forms depending on necessities.

In 2007, the above-mentioned investigative process was conducted on a total of 3,820 individuals including bereaved family members, witnesses, and witnesses of the incidents. As a result, some 8,600 victims were uncovered.

Categorized by each region, there found 1) 356 victims in Ganghwa-gun, 2) 385 victims in Cheongwon-gun, 3) 365 victims in Gongju-si, 4) 373 victims in Yeocheon-gun, 5) 517 victims in Cheongdo-gun, 6) 283 victims in Gimhae, 7) 1,880 victims in Gochang-gun, 8) 2,818 victims in Youngam-gun, and 9) 1,318 victims in Gurey.

Divided by a type of damage, there found 1) 1,457 leftist guerilla victims by the army or police forces of the South Korea, 2) 1,348 Bodo League member victims, 3) 1,318 local leftist victims, 4) 1,092 victims from Yeosun Incident, and 5) 892 victims accused of being collaborators of the North Korea, etc.

External Affairs

1) Collaboration with Truth-finding Organizations and Regional Autonomous Entities

The Truth and Reconciliation Commission of the Republic of Korea (hereinafter, referred to as “TRCK”) is an organization independent from any governmental/non-governmental political entities, and has sought to bring out veiled incidents that have never been brought up or wrongfully known, thereby pursuing reconciliation between victims and perpetrators. Particularly, it has been significant to maintain close cooperative relationship with regional autonomous political entities, since the investigations had to cover lengthy time period, almost up to a century, deal with areas across the Korean peninsula, and look thoroughly on substantially immense investigative scale to cover.

(1) Collaboration with Truth Commissions Overseas
The TRCK is an organization established to deal with truth-finding issues from the past, and thus it has been very critical to pull out close assistance from the governmental authorities such as the nation’s police forces, the Ministry of Defense, and the National Intelligence Service (formerly known as “KCIA”), etc. The TRCK has held a monthly gathering of heads of truth-finding commissions and had meetings and seminars with the national police, the Ministry of Defense, and the National Intelligence Service, etc. Through building cooperative relationship among the mentioned organizations, the TRCK sought to increase efficiency in carrying out its works by exchanging concerned documentations, sharing thoughts on the selection of research subjects, and adjusting duplicated investigations, etc.
Furthermore, the TRCK co-hosted a conference on ‘Evaluation of Truth-finding Works and the Prospect Thereof’ with the Presidential Commission on Suspicious Death in the Military, the Truth Commission on Forced Mobilization under the Japanese Imperialism, the Presidential Committee for the Inspection of Collaborations for Japanese Imperialism, etc. The concerned commissions shared various field experiences with respect to truth-finding work and exchanged ideas through various seminars and conferences.

(2) Collaboration with Regional Autonomous Bodies
The TRCK is authorized to allocate parts of its missions to local autonomous entities or to carry out the missions in cooperation with them. Currently, receiving petitions, promoting application procedures, and implementing ground researches, etc. have been conducted in cooperation with local autonomous entities.
The TRCK, together with other 246 local autonomous entities, promoted its entitled missions and encouraged to file concerned petitions for a year starting on Dec. 1, 2005. During the period, Song Ki-in, the first president of the TRCK visited 16 different cities and numerous civic groups, and actively engaged in media liaison activities to raise awareness on the significance of truth-finding works assigned to the TRCK.
As a result, a total of 10,860 petitions were filed. The number is considerable, since most of filed incidents were taken place decades ago and there still isn’t concrete trust built between the victimized and the authorities.

2) Collaboration with Bereaved Family Members and Relevant Organizations

The TRCK is entitled to ask experts to join researches concerned with the mandates of the commission, hold conferences to hear advises from experienced professionals regarding truth-finding works. Especially, in the case of investigations on Korea’s independent movement and Korean communities abroad, the commission could carry out relevant investigation in collaboration with relevant research institutes or other agencies specialized in concerned investigative areas.
There was such diversity in scopes of characteristics of investigative institutes and there also were a lot of them that the commission had to deal with. Particularly, the bereaved family union of the civilian victims sacrificed during the Korean War takes up a large portion of petitions filed at the commission, and thus close cooperation and keen assistance from the union was essential.
The TRCK has been making utmost efforts to resolve misunderstandings from more than 50 bereaved family unions, if any, and raise awareness on the commission’s mandates through continuous seminars and meetings. Additionally, the TRCK paid special attention on civic groups to collect diverse opinions and to promote the mandates and missions the TRCK was assigned onto through seminars and forums, thereby attempting to build an alliance there between.

Constitutional Court Rules Property Tax Partly Unconstitutional

The South Korea's Constitutional Court just ruled out yesterday that levying heavier tax on less fortunate while reducing it from the rich, who own more than two homes, is better suit to the spirit of the Korea's Constitution, pointing out it after all is a free capitalist market. The Constitutional Court ruled Thursday that a law levying heavier taxes on high-end home owners is partly unconstitutional, vindicating President Lee Myung-bak's proposed tax cuts to boost the economy. The ruling was the first judiciary interpretation of the comprehensive real estate holding tax levied on South Korea's top 2 percent, which was implemented under the government of Lee's liberal predecessor, Roh Moo-hyun."The real estate holding law, which levies tax on a consolidated family basis, contravenes the Constitution" by discriminating married couples against unwed individuals, Lee Kang-kook, the court's chief justice, was quoted as saying by Yonhap News. The Constitutional Court also ruled a clause in the law imposing taxes on single-home owners for residential purposes not in conformity with the Constitution.The progressive tax has caused a sharp division along ideological and party lines.Seven groups of high-end homeowners, mostly from an affluent district in southern Seoul, have filed constitutional complaints since 2006, claiming the tax is unfair and overlaps with other property taxes. They claim it "violates one's property rights and the principles of a market economy and private ownership," according to documents released by the Constitutional Court.Roh levied the tax under the principle of wealth-distribution, claiming it would help the lower class and cash-strapped provincial governments and curb real estate speculation. It imposes a 1-3 percent tax on those owning property worth 600 million won ($430,137) or more.The court, however, found the family-based taxation regime, which determines the taxable amount by combining the assets of all members of a single family rather than on an individual basis, discriminates against married couples and thus is in violation of the Constitution's family values. The court said, "The protection for marriage and family lives are a much greater value than the stabilization of the real estate market or the prevention of tax evasion, which are pursued by the real estate tax law."Roh once said in a warning to conservatives that he would "make the real-estate holding law more difficult to amend than the Constitution." The Finance Ministry, which initially backed the tax under Roh, announced in September that it was changing its position and that it would now raise the minimum tax base to 900 million won and lower the tax rate to 0.5-1 percent. The move will halve the number of households subject to the surtax to 161,000 from the current 387,000.Finance Minister Kang Man-soo, perceived by many as emblematic of Korea's wealthy elite, once compared the ownership tax law to regulations imposed in Germany under Adolf Hitler, who Kang said "enacted laws with the backing of majority support."With the court's ruling, President Lee's proposed tax cuts will now gain momentum despite warnings from civic groups and opposition parties that the cuts will serve to exacerbate the nation's already-wide income gap.

But whether they were playing ``hwatu'' (a traditional Korean poker-style game) at the time of their capture is drawing attention from the public.Police claim they found the five playing the traditional game and drinking, but the civic group members deny they were playing the card game, alleging police were trying to tarnish their image.``They were playing hwatu and drinking alcohol when police caught them them,'' an officer said.However, the lawyer representing the five denied the allegation, saying, ``They bought soju and asked the worker at the front desk if she had hwatu cards in order to pretend they were there to gamble, because hotel workers might have been suspicious of five male adults gathering in one room.''At the same time, the group issued a statement saying that they were not playing the card game. ``It's a plot by the police to ignite public criticism against candlelit protestors,'' the statement said.The five men went on the run last week after hiding in a Seoul temple for months. They had been staging rallies in the Jogye Temple compound, downtown Seoul, since early July. Police have repeatedly tried to arrest them for organizing illegal rallies but they evaded surveillance by 50 officers.Police learned of their whereabouts through their cell phone records and closed-circuit television recordings, Wednesday. Mass Murder of Accused Leftists in Naju

Twenty seven petitioners filed for a truth verification of a mass murder taken place in Naju, February 26, 1951. According to the petitioners, a total of twenty eight villagers were summarily executed at Cheolcheon-ri, Bonghwang—myeon in Naju-si without adequate judicial procedures with accusation of collaborating with communist guerillas. The TRC found the Naju Police Special Forces was responsible for the atrocity, and recommended the government to officially apologize to the victims, subsequently restore the honor of the dead, and implement preventive measures.

Falsification of an Espionage Charge on Lee Soo-keun

Lee Soo-keun, the former vice president of the [1]Korean Central News Agency in the [2]Democratic People’s Republic of Korea, was exiled to the [3]Republic of Korea through the Demilitarized Zone in March 22, 1967. Lee, then, had worked as an analyst at the [4]KCIA until he was caught by KCIA agents en route to Cambodia under forged passports on January 27, 1969. After returning to South Korea, Lee was charged with violating the National Security Law and the Anti-communist Law by secretly collecting classified information and taking them out of the country, etc. Death sentence was imposed on Lee on May 10, 1969 and his execution was subsequently followed on July 2 of the same year. South Korea’s Truth and Reconciliation Commission, hereby ascertained the KCIA illegally confined Lee, thereby meeting prerequisites of a retrial abiding by the provision 7 under Article 420 and Article 422 of the Criminal Law. The commission also said the illegal confinement during the interrogation, the prosecution solely relying on defendant’s statements failed to satisfy the Rule of Evidence. Hereby, the commission recommended the government with an official apology, restoration of the honor of the dead, and a retrial in accordance with its findings.

Abduction of Taeyoungho

Five petitioners pleaded for a truth verification concerning an abduction case of Taeyoungho crews. The crews were forcibly taken away by the North Korean coast guards when they get caught fishing on the North Korean side of the [5]Military Demarcation Line (MDL). They were sentenced guilty by the South Korean authorities for violating Anti-communist Law soon after they returned from the four-month detention in North Korea. The commission found illegal confinement and torture were imposed to the crews during interrogation at Buan Police Office, which makes the case qualified for a retrial. Additionally, the commission verified the falsification of an espionage charge on the abductees and the prosecution without sufficient evidences, only based on testimonies from the defendants, did not meet the [6]Rule of Evidence. Hereby, the commission advised the government to officially apologize to the victims and have a retrial in accordance with its findings.

Falsified Espionage Charges on Shin Gui-young’s Family

Shin Gui-young was sentenced 10 years of imprisonment for allegedly collecting classified military information with an order given by Shin Soo-young, the senior member of [7]Chosen Soren in Japan. Shin was sentenced guilty at the Busan District Court in 1980 and released upon completion of his 10 year term. The commission ascertained the forceful confinement and the torture given to Shin violated the rule of evidence, thereby advising the government with an official apology and a retrial in accordance with the findings.

Aram-hoe Incident

Park Hae-jeon et. al., a total of eleven residents of Geumsan and Daejon of which occupations varied from teacher, student, salary man, soldier, housewife, etc., had held a regular meeting between May 1980 and July 1981, based on friendship originated from their school days. They were taken to the Daejon Police Office and arrested soon after for having inappropriate gatherings and subsequently exchanging traitorous conversation therein. They were accused of violating the National Security Law by constituting a treasonous organization and praising enemies of the nation, and sentenced with the 10 years of imprisonment and suspension, etc. The commission found the concerned investigative institutes including Chungcheongnam-do’s Provisional Police Station conducted illegal confinement, brutal torture, and improperly imposed charges on the victims without sufficient evidence. Hereby, the TRC recommended the government with a retrial of the case along with an official apology to the victims.

The founder of Wikipedia said the South Korean government efforts to impose rules for Internet users will eventually fail.

Struggling to cope with the online criticism of its policies, the Lee Myung-bak government has been considering new laws to control Internet postings, which include plans to limit anonymity at commonly used Web sites and strengthening regulations for all sites publishing news.

``Overkill,'' says Jimmy Wales, the founder of the online encyclopedia, referring to a legislative effort by the government.

``This is certainly a dangerous path to go down,'' Wales told The Korea Times on the sidelines of a Web industry conference in southern Seoul Tuesday.

``The governments that are given the power to block things usually tend to block things, including information that originally wasn't intended to be blocked from access,'' said Wales.

``The most important solution to this kinds of bad behavior in the Internet may rest on the design of community spaces, whether the community has the ability to control what's going on. At Wikipedia, the community quickly identifies and blocks the people that misbehave and delete their negative contributes.

``I am not a big fan of limiting anonymity to have users behave themselves better, as there is very little evidence that actually works anywhere,'' he said.

Wales' distaste for Web surveillance is easy understandable when Wikipedia, an online encyclopedia written and edited by its users, is now widely considered the shining beacon of user-generated content, proof that sometimes an undefined group of amateur volunteers can produce better results than a unit of professionals.

Wikipedia, which has more than 2.6 million articles in English and over 10 million articles in 150 languages, is now one of the world's top 10 most popular Web sites.

Finding a balance between editorial judgment and censorship, thus finding the balance between openness and controlling the quality of content, is a question that faces Wales everyday.

Unlike its image of freewheeling openness, Wikipedia actually empowers a core community of editors and administrators who make decisions on whether to keep or delete articles according to the ``worthiness'' of the subject and credibility of the content.

``Deciding what to delete and what to keep is an ongoing process in the community that requires a lot of discussions and debate, but the most important factor in these judgments is verifiability,'' said Wales.

``The community puts a lot of effort in confirming whether the information is actually true, through third-party verification, consulting with reliable sources and many other factors,'' he said.

Despite the country's high broadband Internet penetration rate, Wikipedia's Korean language page has been struggling to gain acceptance, with just 700,000 articles and around 500 regular contributors.

Daum, the country's No. 2 Internet portal, signed a deal to provide their encyclopedic content to Wikipedia's Korean page and provide them in its search results, which are expected to increase the number of articles to around 180,000.

Risking His Life for North Korean Refugees

MBA Student's Book Tells a Harrowing Tale
Mike Kim (G'09), a financial planner from Chicago, imagined he would return from his two-week vacation in China well-rested and rejuvenated for another year of work. Instead, the young business owner returned to the states shaken, unable to forget the horror stories told to him by North Korean refugees and their children.

"I distinctly remember sitting across from clients talking about mutual funds, retirement plans and insurance while feeling completely disengaged by it all," says Kim of his 2001 trip. "The North Korean refugees I had met on my trip weighed heavily on my heart. At that moment I knew what I had to do – I had to go to China to help."

Leaving his business in Chicago, Kim moved to California to learn Mandarin and Korean, and to prepare himself for humanitarian aid work in China. On New Year's Day 2003, carrying little more than two duffle bags and a one-way ticket, Kim moved to the China-Korea border. He spent the majority of his first year getting to know North Koreans and their culture.

"As our friendships grew, I earned their trust," Kim says. "They opened up and shared their deepest secrets with me – things they had never told anyone else."

Kim shares these refugees' stories with the public in his new book, "Escaping North Korea: Defiance and Hope in the World's Most Repressive Country" (Roman & Littlefield Publishers, Inc. 2008).

"I often sat with pen and paper and listened for hours to the North Korean refugees tell me their stories," Kim says. "Civilians and soldiers alike spoke of what North Koreans think of Americans and war with America … Children remembered the suffering they endured through the famine. Women and girls recalled their horrific experiences at the hands of sex-traffickers. Former political prisoners shared their memories of beatings, torture and executions in the gulags."

Kim's classmate in McDonough School of Business' MBA program says he is left with vivid images of the life that North Korean refugees face.

"Some stories are so shocking that there were times when I had to put the book down for a moment to digest what I had just read," says Steven Schuler (G'09). "Mike is modest about his accomplishments, so as a classmate I'm proud for him, both for his work directly with refugees … and for bringing attention to the situation."

One of the few Americans granted entry into North Korea, Kim came to know the isolated country and its people intimately.

"This is a story of heroes – of North Koreans … risking their lives to flee the world's most repressive dictatorship. And of a heroic young Korean American, the author, Mike Kim, who risked his own life for four years on the China-North Korea border," Mark Palmer, vice chair of Freedom House and the Council for a Community of Democracies, writes in the book's introduction. Palmer, a former U.S. ambassador to Hungary, sits on the Walsh School of Foreign Service's Institute for the Study of Diplomacy board.

Living on the China-North Korea border, Kim quickly learned of the hundreds of thousands of North Koreans fleeing to China in search of food and freedom via a 6,000-mile modern-day underground railroad through Asia. With increased security at embassies and consulates in China, Kim risked his own life leading North Koreans on the treacherous journey across the border to asylum in China. He spent four years working with the refugees on the Chinese border before returning to the United States.

"This is an inspiring yet tragic study of the brave few in North Korea who have chosen to vote with their feet to leave the earth's most repressive regime," says Victor Cha, director of Asian studies and D. S. Song-Korea Foundation Chair in Asian Studies and Government.

In addition to writing his book, which is available at the Main Campus bookstore, Kim also founded the nongovernmental organization Crossing Borders Ministries, which provides food, clothes, shelter and medicine to North Korean refugees in China. Since 2003, Kim's organization has established 25 refugee shelters and five orphanages near the China-North Korea border, and has saved hundreds of refugees fleeing for their lives.

"Through our shelters, children who might have ended up in gangs or brothels now have a chance at life … We stress education and encourage them to dream," says Kim. "By applying both humanitarian aid and faith effectively, Crossing Borders is, I believe, a model for the future."

Born and raised in Chicago, Kim graduated in 1999 from the University of Illinois at Urbana-Champaign with dreams of attending business school. Now a full-time MBA student at the McDonough School of Business, Kim says he plans on returning to nonprofit work in the future.

"In moving to the China-North Korea border to help some of the most destitute people in the world today, I feel that I have been liberated," Kim says. "As much as I have taught them, they have taught me more … and in helping them, I have gained a greater sense of purpose and fulfillment for my own career."

DongA Ilbo and the government are told to apologize for past civil rights violations

Truth and Reconciliation Commission report finds DongA colluded with KCIA to fire journalists during Park Chung-hee era

In the latest of a series of findings, the official government Truth and Reconciliation Commission has determined that one of the more famous press suppression cases of the Park Chung-hee years, the “DongA Ilbo Advertising Coercion and Forced Layoff Case” during 1974 and 1975, was orchestrated by the Korean Central Intelligence Agency (KCIA, now known as the National Intelligence Service), and that the DongA Ilbo itself went along with what was unjust oppression by the Yusin regime, as it was called.


In a report issued October 29, the commission formally recommends that the state and the DongA Ilbo “apologize to those who were fired and make appropriate amends” for what the report defines as “a case in which the state power apparatus, in the form of the KCIA, engaged in serious civil rights violations.”


According to the commission, the KCIA summoned companies with significant advertising contracts with the DongA Ilbo Company to the KCIA’s infamous facility in Seoul’s Namsan neighborhood and had them sign written documents pledging to cancel their contracts with the company for advertisements with its various periodicals, including the daily DongA Ilbo, and also with DongA Broadcasting, which Chun Doo-hwan later took from them.



Individuals who bought smaller advertisements with the DongA Ilbo expressing encouragement to the paper were either called in or physically detained by the KCIA and threatened with tax audits.


The commission cited the DongA Ilbo for “surrendering to the unjust demands of the Yusin regime by firing journalists at the government’s insistence, instead of protecting the journalists that had stood by the newspaper to defend its honor and press freedom.” The report says the KCIA demanded, and the DongA Ilbo accepted, the condition that no less than five newspaper section chiefs always confer with the KCIA before resuming advertisements.


On seven occasions between March and May of 1975, the DongA Ilbo fired 49 journalists and “indefinitely suspended” the employment of 84 others. The commission cited executives at the time for “failing to admit that the firings were forced by the regime” and for thereby “going along with suppression of press freedoms for claiming they were being fired for managerial reasons.”


“Ultimately,” the report says, the DongA Ilbo “will find it hard to avoid responsibility for hurting the freedom of the press, the livelihoods of journalists, and (its own) honor.”


Later on the day the report was made public, members of the Struggle Committee to Defend Press Freedom at the DongA (DongA Teugwi), an organization of journalists who were fired at the time, met with the media in front of the DongA Ilbo Company’s offices along Seoul’s Sejongno boulevard to read a statement calling on the government and the newspaper to “accept the recommendation of the Truth and Reconciliation Commission and apologize to us journalists, and take action commensurate with what happened to correct the damage.”


Many of the journalists suspended or fired from the DongA Ilbo later went on to found The Hankyoreh.

The Japanese Prime Minister pledged, "From now on, I will make statements while bearing in mind the gravity of the words of a prime minister." But never apologied the victims about the forced labor his family firm of "ASO Mining Co." implemented upon the POWs of the war in 1945.

After evading the issue for more than two years, Taro Aso conceded to foreign reporters on the eve of becoming prime minister that Allied POWs worked at his family's coal mine in Kyushu during World War II.

But Aso's terse admission fell far short of the apology overseas veterans' groups have demanded, while refocusing attention on Japan's unhealed legacy of wartime forced labor by Asians and Westerners.

Calls for forced labor reparations are growing louder due to Prime Minister Aso's personal ties to the brutal practice, as well as his combative reputation as a historical revisionist. The New York Times recently referred to "nostalgic fantasies about Japan's ugly past for which Mr. Aso has become well known." Reuters ran an article headlined "Japan's PM haunted by family's wartime past."

Three hundred Allied prisoners of war (197 Australians, 101 British and two Dutch) were forced to dig coal without pay for Aso Mining Co. in 1945. Some 10,000 Korean labor conscripts worked under severe conditions in the company's mines between 1939 and 1945; many died and most were never properly paid.

Taro Aso was president of Aso Cement Co., the successor firm to Aso Mining, during the 1970s and oversaw publication of a 1,000-page corporate history that omitted all mention of Allied POWs. Aso's father headed Aso Mining during the war. The family's business empire is known as Aso Group today and is run by Aso's younger brother, with the prime minister's wife serving on the board of directors. The company has never commented on the POW issue, nor provided information about Aso Mining's Korean workforce despite requests from the South Korean government.

Newspapers in Australia and the United Kingdom vigorously reported Aso Mining's use of POWs in 2006. But with Aso then at its helm, Japan's Foreign Ministry cast doubt on the overseas media accounts and challenged journalists to provide evidence.

Last year The Japan Times described how, in early 1946, the Japanese government presented Allied war crimes investigators with the Aso Company Report, detailing living and working conditions for the 300 prisoners. Yet Foreign Minister Aso continued to sidestep the POW controversy even after his office was provided with a copy of the report, which is written on Aso Mining stationery and bears company seals.

Courts in Japan and former Allied nations have rejected legal claims by ex-POWs, so the U.K., Canada, Australia, New Zealand, the Netherlands and Norway have all compensated their own surviving POWs. Hundreds of British and Dutch POWs and family members have made reconciliation-style visits to Japan in recent years as part of the Tokyo-sponsored Peace, Friendship and Exchange Initiative. Stiffed by the U.S. government, American POWs have also been excluded from Japan's reconciliation schemes — a situation they say Prime Minister Aso has a special responsibility to correct.

Some 700,000 Korean civilians — including teenage girls — were brought to Japan to work for private firms through various means of coercion. Hundreds of thousands of other Koreans were forced to perform harsh labor elsewhere in Japan's empire or conscripted into the Japanese military.

South Korea's 85-member Truth Commission on Forced Mobilization Under Japanese Imperialism began work in 2005. Legislation passed last year will provide national payments of up to $20,000 to former military and civilian conscripts and family members. The measure also calls for individually tailored compensation based on unpaid wages, pension contributions and related benefits owed to Korean workers but now held by the Bank of Japan.

Seoul needs Japanese cooperation in the form of name rosters and details about the BOJ financial deposits in order to fully implement its compensation plan. Repatriating the hundreds of sets of Korean remains currently stored in Japan, many of them belonging to military and civilian conscripts killed during the war, is another key aim of ongoing reparations work. Company records would greatly aid the process of identifying remains that have been located in temples and municipal charnel houses around the country.

The Japanese government has been cooperating fitfully on "humanitarian grounds" in the case of military conscription, supplying Korean officials with some wartime records and returning the remains of 101 Korean soldiers to Seoul last January. But the Japanese side is mostly stonewalling on civilian conscripts like those at Aso Mining.

Japanese officials contend, rather implausibly, that they do not know how many Korean civilians were conscripted or how many died in the custody of private companies because the state was never directly involved. South Korea's truth commission criticized Aso Group and Foreign Minister Aso in 2005 for failing to supply information.

"I have no intention to explain," Japan's chief diplomat told a Japanese reporter at the time. Earlier this month, Diet member Shokichi Kina asked Prime Minister Aso whether any data about Aso Mining was ever given to South Korea. Aso replied that his administration will not disclose how individual corporations have responded to Korean inquiries.

Noriaki Fukudome of the Truth-Seeking Network for Forced Mobilization, a citizens group based in Fukuoka, has been centrally involved in advancing the South Korean truth commission's work within Japan.

Aso Group, says Fukudome, "has an obligation to actively cooperate with returning remains and providing records because it was one of the companies that employed the most forced laborers. But Japanese companies are keeping a lid on the whole forced labor issue. In the unlikely event that Prime Minister Aso was to direct Aso Cement (now Aso Lafarge Cement since its merger with a French conglomerate) to actively face the forced labor problem, it would have a huge effect on all Japanese companies."

Fukudome pointed to Japan's conformist corporate culture as one reason why very few of the hundreds of companies that used Asians and Allied POWs for forced labor have taken steps toward reconciliation. "Even if one company has a relatively positive attitude regarding reparations, it will not take action out of deference for other companies," he said.

Chinese were the victims of the third class of forced labor in Japan. While Aso Mining was not involved in Chinese forced labor, lack of progress for the especially compelling redress claim highlights Japan's weak commitment to settling wartime accounts.

Postwar records secretly compiled — and then purposely destroyed — by the Japanese government and 35 companies state that 38,935 Chinese males between the ages of 11 and 78 were brought to Japan between 1943 and 1945. More than one out of six died.

Japan's Supreme Court ruled last year that the 1972 treaty that restored ties between Japan and China bars Chinese forced labor survivors from filing legal claims. Yet the court found that plaintiffs had been forcibly transported to Japan and forced to toil in wretched conditions, and suggested they be redressed through non-judicial means. Having previously declared that the "slave-like forced labor was an outrage against humanity," the Fukuoka High Court earlier this month similarly urged "voluntary measures" to remedy the injustice.

Kajima Corp., one of the world's largest construction companies, set up a "relief fund" in 2000 to compensate survivors of its Hanaoka work site, where 418 out of 986 Chinese perished and an uprising took place. The move prompted expectations that Japan's industrial sector and central government might establish a redress fund for all its victims of forced labor, similar to the "Remembrance, Responsibility and the Future" Foundation enacted in Germany that same year. The $6 billion German fund eventually compensated 1.6 million forced labor victims or their heirs.

Such hopes for corporate social responsibility in Japan were dashed. On the contrary, Mitsubishi Materials Corp. defended itself in a Fukuoka courtroom in 2005 by rejecting facts about Chinese forced labor routinely recognized by Japan's judiciary and insisting only voluntary workers were used — despite death rates of up to 31 percent at its Kyushu mines. Mitsubishi openly questioned whether Japan ever "invaded" China at all and warned judges that compensating the elderly Chinese plaintiffs would saddle Japan with a "mistaken burden of the soul" for hundreds of years.

Taro Aso, in fact, is not the Japanese prime minister most closely connected to forced labor. Wartime Cabinet minister Nobusuke Kishi was in charge of the empire's labor programs and was later imprisoned for three years as a Class A war crimes suspect. Kishi went on to become a founder of the Liberal Democratic Party in 1955 and Japan's premier from 1957-60. Former Prime Minister Shinzo Abe is Kishi's grandson.

Foreign Ministry files declassified in 2002 revealed that Kishi's administration conspired to deceive the Diet and citizens' groups about the state's possession of Chinese forced labor records. Kishi's intent was to block Japanese activists from returning remains to China and publicizing the program's true nature, as well as to head off state reparations demands from Beijing. In 2003, the Foreign Ministry searched a basement storeroom and found 20,000 pages of Chinese forced labor records submitted by companies in 1946, despite decades of denials that such records existed.

Millions of Asians performed forced labor outside of Japan during the Asia Pacific War, very often for the benefit of Japanese companies still operating today. The so-called comfort women represent a uniquely abused group of war victims forced to provide sex for Japan's military. Last year governments in North America and Europe urged Japan to do more to right the egregious comfort-women wrong.

The Dutch foreign minister renewed that call last week, prior to a visit to Japan set to include a stop at the Commonwealth War Cemetery where hundreds of Allied POWs are buried, including two Australians who died at Aso Mining.

Days after assuming Japan's top post, Aso apologized "for my past careless remarks" in a speech before Parliament. "From now on," he pledged, "I will make statements while bearing in mind the gravity of the words of a prime minister." Many are waiting for the words "I'm sorry" for forced labor.

진실·화해를위한과거사정리위원회(위원장 안병욱. 이하 진실위)는 1974년 동아일보 광고탄압 및 1975년 기자 해직 사건과 관련, 당시 중앙정보부(현 국가정보원)가 적극 주도한 사실을 확인했다고 29일 밝혔다.

진실위 조사결과에 따르면 중앙정보부는 1974년∼1975년 동아일보사와 계약한 대형 광고주들을 남산 중앙정보부로 불러 동아일보와 동아방송, 여성동아, 신동아, 동아연감 등에 내고 있던 광고를 취소하고 광고를 주지 않겠다는 서약서와 각서를 쓰게 했다.

또 소액광고주들에게도 중앙정보부 출두, 경찰 연행 조사, 세무사찰 등의 방법으로 광고 중단 압력을 가했다.

중앙정보부는 또 광고를 다시 수주할 수 있도록 해주는 조건으로 핵심부서 5개 국장의 인사문제를 협의할 것과 정부 정책에 비협조적이었던 점을 사과하는 기사를 게재할 것을 요구하기도 했다.

진실위는 비슷한 시기 조선일보에서도 언론인들이 상당수 해임되고 기자협회보가 강제 폐간된 사실을 확인했다고 밝혔다.

진실위는 "이 사건은 동아일보에 대한 부당한 탄압일 뿐 아니라 기업활동의 자유, 언론의 자유, 양심의 자유 등 헌법에 명시된 국민의 기본권에 대한 심각한 훼손"이라고 강조했다.

진실위는 1975년 기자 강제 해직사건과 관련, "동아일보는 자사의 명예와 언론자유를 위해 헌신했던 기자들을 유신정권의 부당한 요구에 굴복해 해임하고서도 진실을 시인하지 않았다"며 "피해 언론인들의 생존권과 명예를 침해했다"고 말했다.

진실위는 이에 따라 국가에 동아일보사와 피해 언론인들에게 사과하고 정당한 평가와 피해 회복을 위한 적절한 조치를 취할 것을 권고하고 동아일보에 대해서도 관련 언론인들의 피해와 명예를 회복시키는 조치를 취할 것을 권고했다.

`동아사태'는 1974년 10월23일 서울대학생 데모에 대한 기사를 게재했던 당시 송건호 편집국장 등 동아일보 기자들이 중앙정보부로 연행된 것이 직접적인 발단이 됐다.

동아일보 기자들이 다음날 자유언론실천선언을 발표하고 일주일 만에 35개사 언론인들이 `언론자유'를 외치며 동참을 선언하자 중앙정보부는 `광고중단 압력'을 넣었고 사측은 1975년 3월부터 모두 7차례에 걸쳐 49명을 해임하고 84명을 무기정직 처분했다.

당시 해임된 기자들로 구성된 동아자유언론수호투쟁위원회는 이날 성명을 통해 "참으로 오랜 기다림이었다"며 "33년 전 `동아사태'가 이제 낱낱이 밝혀진 이상 정부와 동아일보는 마땅히 피해 회복에 적극 나서야한다"고 촉구했다.

그러나 동아일보측은 "진실위가 중앙정보부 전 직원의 진술만으로 회사가 압력에 굴복했다고 말하지만 사실이 아니며 동아일보측에 관련 내용에 대해 질의한 적도 없다"며 "당시 해임은 광고수익 감소 등 경영악화로 말미암아 이뤄진 일"이라고 반박했다.

동아일보측은 특히 "이미 대법원도 관련 사건에 대해 `경영상의 해직'이라고 판결을 내린 바 있어 법률적으로도 완료된 사안"이라고 덧붙였다.

History teachers launch campaign against textbook revisions

History textbooks in Korea are written and published based on the guideline drawn by its government. This is rather odd from the beginning for a country claiming to be a democratic society where the freedom of speech is guaranteed.

Now, since the new government took the office, neo-conservative power's been surged in this land of morning calm, and now they, represented by a right civil group called "New Right," asks to revise the textbook guideline. Of course, much awes are coming from the progressives, historians, and educators within/outside the nation. See more details below.

Following history scholars, history teachers nationwide launched a campaign to sign a “history educators’ declaration,” which says the “government’s move to revise the (history textbook) ‘A Modern and Contemporary History of Korea’ has fundamentally shaken the textbook authorization system and undermines the neutrality of education as guaranteed by the Constitution.”


On October 19, the National History Teachers Association said, “History educators have begun to take action because they can not endure the government’s move to revise the history textbook in a direction that would comprehensively deny the political neutrality of education, which society has worked hard to gain.”


Since October 16, the NHTA has encouraged its members to sign the declaration on its Web site (http://okht.njoyschool.net) with a series of e-mails and mobile-phone text messages and has raised funds to advertise the declaration, which over 300 history teachers have signed in just three days.



Yun Jong-bae, the director of the NHTA, said, “With history teachers and scholars we will announce the ‘history educators’ declaration’ three times by the end of this month via advertisements in the media when the government finalizes the proposed revision. This is a rare moment because history teachers nationwide have collectively taken direct action to criticize the government’s policy. That underscores how seriously they perceive this issue.” Of the 7,000 history teachers at middle and high schools nationwide, some 1,500 are members of the NHTA.


Jo Han-gyeong, a Korean history teacher at Bucheon North High School in Gyeonggi Province, said, “Last year, I taught students using Kumsung Publishing’s ‘A Modern and Contemporary History of Korea.’ I have read the textbook hundreds of times, but it is ridiculous to hear that the textbook is pro-North Korea, anti-U.S. and left-leaning. I decided to come forward because I can not endure the government’s absurd move to force students to examine history from only one point of view.”


Lee Seong-ho, a teacher at Baemyeong Middle School in the Songpa district in Seoul, said “If history education is shaken by political changes, classrooms will quickly become confused. I feel embarrassed for the government because it can not maintain the authorized textbook system.”

‘한국판 마타하리’ 김수임 사건 美 비밀문서 집중분석

1950년 한국 사회를 떠들썩하게 만들었던 김수임. 그 앞에는 항상 ‘미모의 여간첩’ ‘한국판 마타하리’란 수식어가 따라붙는다.

그는 광복 직후 남한 최고 권력자의 하나였던 주한미군 헌병사령관 베어드 대령의 내연녀였다. 동시에 북한 최고 실력자의 한 명이었던 이강국(북한 초대 외무부장)의 애인이었다. 1946년 미 군정청이 이강국에 대해 체포령을 내리자 베어드 대령의 차를 이용해 월북시켰는가 하면, 이강국의 지시에 따라 남한의 군사비밀을 빼돌리는 등 간첩활동을 한 혐의로 1950년 4월 체포돼 6월 사형당했다. ‘애인’ 이강국 역시 6·25전쟁 종전 직전 북한에서 간첩혐의로 처형당했다.

사라진 재판기록

이처럼 그는 반공의식을 고취시킬 대표적 사례였을 뿐 아니라 삼각관계, 죽음, 비극적인 사랑 등 극적인 요소가 많아 오랫동안 영화와 드라마, 소설의 단골 소재로 인구에 회자됐다.

1950년 미국잡지 ‘코로넷(Coronet)’에서는 그를 ‘남한 사교계의 여왕은 빨갱이였다’라는 제목의 기사로 소개하며 ‘미국을 배신한 한국인 팜파탈’이라고 규정했다. 그의 이야기는 미국에서도 드라마로 여러 편 제작될 정도였다. 로널드 레이건이 주연한 드라마에서는 ‘아시아의 마타하리’로 묘사됐다. 워싱턴의 칼럼니스트 드류 피어슨은 ‘그의 간첩행위가 6·25전쟁이 전면전으로 비화하는 도화선이 됐다’며 6·25전쟁을 유발시킨 장본인으로 규정하기도 했다.

우리나라에서도 영화 ‘나는 속았다’(1963), ‘특별수사본부 김수임의 일생’(1974), TV드라마 ‘제1공화국-여간첩 김수임’(1981), 실화소설 ‘특별수사본부-여간첩 김수임’(1980) 등을 통해 주로 ‘붉은 여간첩’ ‘한국판 마타하리’로 그려졌다. 또한 가택수색을 하러 온 수사관들에게 술상을 차려주는가 하면, 미리 몸단장을 할 수 있도록 사형 전날 알려달라고 당부했다는 ‘요부’ 이미지로 그려지기도 했다.

우리 사회가 민주화하면서 김수임을 바라보는 시각도 조금씩 달라졌다. 사랑에 목숨까지 바친 ‘순수한 여인’, 사랑 때문에 간첩행위까지 했으나 결국엔 사랑마저 이용하는 공산주의자에게 이용만 당하고 버림받은 ‘가엾은 여인’으로 그려졌다. 배우 윤석화가 김수임 역을 맡은 연극 ‘나, 김수임’(1997), 김수임의 대학후배 전숙희씨의 실화소설 ‘사랑이 그녀를 쏘았다’(2002), 드라마 ‘서울 1945’(2006) 등이 그것이다.

학계 일각에선 ‘남북대립 상황에서 반공 이데올로기를 전파하기 위한 도구로 활용됐다’ ‘좌우 이데올로기 대립과 미군정의 과도기에 벌어진 정치게임의 희생양’이라는 주장도 제기됐지만, 이를 뒷받침할 증거를 제시하지는 못했다. 사건의 진실을 파악할 자료가 너무 빈약했기 때문이다.

예를 들어 규정상 영구보존해야 하는 판결문 등 재판기록마저 행방불명이다. 앞뒤의 사건기록과 판결문은 다 남아 있는데 김수임 사건 기록만 사라졌다. 따라서 언제 사형이 집행됐는지조차 공식기록이 없다.

그런데 최근 미국 AP통신에서 그의 죽음과 관련 새로운 시각을 보도했다. 비밀 해제된 ‘베어드 조사보고서(이하 베어드 파일)’ 등 미 국립문서보관소(NARA)에서 발굴한 1950년대 기밀자료들을 분석한 결과 지금까지 알려진 사실과는 사뭇 차이가 있다는 것. 사건 자체가 조작됐을 가능성이 크다는 의혹이 제기됐다.

‘베어드 파일’은 미 육군성이 작성한 비밀문서다. 미 육군성은 1950년 8월2일부터 김수임의 자백 및 재판기록을 토대로 베어드 대령의 관련 여부에 대해 조사했다. 그가 정부(情婦)인 김수임에게 주한미군에 대한 정보를 제공했는지 여부와 그녀의 공산주의 활동을 보호, 지원했다는 사실을 입증하는 게 핵심이었다. 3개월에 걸친 조사를 마친 뒤 300여 쪽에 달하는 보고서를 작성했는데, 이게 ‘베어드 파일’이다.

기사에 따르면 김수임 사건의 진실을 밝히기 위해 노력하고 연구한 사람은 바로 김수임의 아들 김원일(59·캘리포니아 라시에라대학·신학) 교수였다. 김 교수는 10년 넘게 어머니 김수임을 연구했는데, 그가 찾아낸 자료만 ‘베어드 파일’ 등 1000여 쪽에 달한다고 한다. 그리고 김 교수의 곁에는 김수임을 새로운 시각으로 영화화하려는 조명화(63) 감독이 있었다. 조 감독 역시 6년째 김수임을 연구 중이라 서로 자료와 정보를 교환해왔다.

김원일 교수가 발굴한 베어드 파일 등 미국의 기밀문서들과 김수임 사건 재판 보도 기사, 북한의 이강국 재판기록, 관련자들의 증언 등을 토대로 김수임 사건의 진실을 재조명했다.

파란만장한 삶

출생에서 죽음까지 김수임의 삶은 말 그대로 파란만장했다. 1911년 개성에서 빈농의 딸로 태어난 그는 어려서 부모가 이혼하고 각각 재혼해 가계(家系)가 복잡하다. 어머니가 다른 이복(異腹)동생도, 아버지가 다른 이부(異父)동생도 있다. 가난으로 11세 때 민며느리로 팔려가기도 했다. 하지만 미국 선교사의 도움으로 서울로 올라와 학업을 계속할 수 있었고, 총명한 머리로 이화여전 영문과를 뛰어난 성적으로 졸업했다. 그렇다고 외모까지 출중한 편은 아니었던 모양이다. 베어드 파일엔 서울 옥인동 자택에서 찍은 2장의 사진을 첨부한 뒤 “알려진 것(대단한 미인)과 실제 외모 사이에는 차이가 있다”는 메모가 붙어 있다.

1932년 대학을 졸업한 그는 성공회 기숙사에서 기거했는데, 학창시절부터 알고 지내던 시인 모윤숙과 같은 방을 썼다. 능통한 영어 실력으로 세브란스병원 치과과장 비서 겸 통역으로 일했다. 지인들은 그를 사교적이고 활동적이었으며 폭스트롯(사교춤의 일종)을 잘 추고, 패션 감각도 있었다고 기억했다. 모윤숙은 에세이 ‘회상의 창가에 서서’에서 김수임을 “마태복음을 줄줄 외는 기독교 신자” “아주 명랑하고 어떤 장소에서든 웃음을 한 바가지씩 들고 나오는 여자”라고 표현했다.

김수임은 이 무렵에 이강국을 만났다. 이강국은 당대 최고의 수재로 유명했으며 독일 유학까지 다녀온 엘리트였다. 전숙희씨는 ‘사랑이 그녀를 쏘았다’에서 1929년 이강국이 원산노동자총파업과 관련해 구속됐을 때 모윤숙이 김수임을 데리고 면회를 가면서 두 사람이 처음 알게 됐다고 기록했지만, 사실이 아닌 듯하다. 당시 이강국이 구속됐다는 기록이 전혀 없다. 이강국은 1938년에 구속된 적이 있는데 이때 이야기가 아닌가 싶다.

김수임과 이강국은 각각 자신의 재판에서 두 사람이 만난 것은 1940년대 초였다고 진술했다. 특히 김수임이 “1942년 동무의 집에서 윷을 놀다가 우연히 알게 되었는데, 첫인상이 좋아 교제를 시작했다”고 구체적으로 진술한 것이 눈에 띈다. 두 사람은 사회주의운동을 함께 하며 동지에서 연인으로 발전했다.

해방 정국에서 이강국은 여운형을 중심으로 수많은 사회단체와 정당들이 연합 결성한 민족주의민족전선(약칭 민전) 사무국장에 오르면서 정치적 입지를 굳혀간다. 하지만 1946년 8월 동아일보에 미군정을 비판하는 칼럼을 발표하자 미군정에서 그에 대한 체포령을 내린다. 이에 김수임의 도움으로 북한으로 탈출한다.

반면, 김수임은 선교사의 추천으로 반도호텔에 취직한다. 당시 반도호텔은 미군정 사무실로 사용되고 있었다. 그는 미군 헌병대장 베어드 대령의 통역 겸 수행비서로 일했다.

베어드의 배신

김수임이 어떻게 베어드와 인연을 맺었는지는 분명하지 않다. 전숙희씨는 “김수임이 피했지만 베어드가 워낙 김수임을 좋아해 계속 쫓아다녔다. 결국 자기도 외로우니까 받아들였다”고 증언했다. 하지만 김수임은 이강국을 월북시킬 때(1946년 9월) 이미 베어드가 마련해준 옥인동 집에 살았다. 두 남자를 동시에 만났던 셈이다.

베어드 파일에 의하면 베어드는 김수임을 위해 집(옥인동 19번지)을 마련하고 동거했다. 김수임은 1949년 11월 베어드의 아이를 낳았다. 김수임의 친구였던 낸시 킴은 “그녀는 베어드 대령의 아이를 가졌습니다” “우리는 모든 것을 알고 있었지요. 그는 당시 김수임의 유일한 남자친구였어요. 그는 그 집에서 여러 밤을 보냈습니다. 아이도 아버지를 닮았습니다”라고 증언했다. 김수임은 임신 사실이 외부에 노출되는 것을 꺼려서인지 출산을 전후해 6개월 동안 청량리 위생병원에 장기입원하기도 했다.

김수임이 한국 수사당국에 검거된 것은 1950년 4월21일이었다. 검거과정도 불분명하다. 김수임과 모윤숙은 생일이 비슷해 기숙사 시절부터 한날에 생일파티를 함께 하곤 했다. 그가 붙잡힌 날은 모윤숙의 생일(음력 3월5일)이었다.

검거 당시 상황을 기록한 것으로는 모윤숙의 에세이와 전숙희의 실화소설, 오제도 검사의 수기가 있다. 그런데 붙잡힌 상황 설명이 저마다 다르다. 모윤숙은 김수임이 먼저 자신에게 전화를 걸어 집에 오겠다고 해 자기 집에서 함께 밥을 먹고 있는데 경찰들이 들이닥쳤다고 기록했다. 반면 전숙희는 모윤숙이 먼저 김수임에게 자신의 집으로 와서 밥을 먹자고 전화를 해서 김수임이 집을 나섰다가 경찰에 붙잡혔다고 적고 있다.

당시 김수임이 살던 옥인동 19번지는 미군 관할 구역이라 한국 경찰이 함부로 들어갈 수 없었다. 따라서 김수임을 붙잡으려면 그를 집 밖으로 끌어내야 했다. 그래서 모윤숙이 김수임을 밖으로 불러낸 것 아니냐는 의혹이 제기되기도 했다.

조명화 감독은 “베어드가 가장 나쁜 사람”이라고 말했다.

“베어드는 처녀였던 김수임에게 접근하면서 ‘본국에 아내와 자식이 있지만 사이가 안 좋아 이혼수속 중이다. 내가 한국근무 끝나면 결혼해 미국에 가서 살자’고 했다. 김수임은 그렇게 믿었을 것이고, 그래서 낙태를 하지 않았을 것이다. 모윤숙의 증언에 따르면 베어드는 김원일의 백일잔치에도 참석해서 무척 좋아했다고 한다. 그런데 실제로는 1949년에 베어드의 부인과 아들이 한국에 와서 함께 살고 있었다. 김수임을 속인 것이다.

또한 김수임이 한국 경찰에 잡혔을 때, 베어드는 그를 구할 수 있는 힘을 갖고 있었다. 김수임이 간첩이 아니라면 누구보다도 그걸 증언해줄 위치에 있었다. 하지만 그는 아무것도 하지 않았다. 더구나 김수임의 재판이 열리기도 전에 서둘러 한국을 떠나 미국의 가족에게 가버렸다. 갓난아이까지 팽개치고.”

간첩 논란의 쟁점과 진실

1950년 6월14일, 베어드가 한국을 떠난 지 9일 후, 김수임은 남한 군사법정에 섰다. 처음엔 혐의가 19가지였지만 정식 기소장에 기재된 것은 13가지였다. 가장 중대한 혐의라 할 수 있는 ‘1948년 12월에 육군특무대에 수감 중이던 남로당의 빨치산 총책인 사형수 이중업을 빼내 의사로 가장시켜 월북시켰다’는 혐의를 입증할 수 없었던지 기소장에서 삭제했다. 가택수색 과정에서 집에서 권총 3자루와 총알 180정이 나왔다든지, 북한으로 보내려던 많은 기밀물건이 압수됐다든지 하는 내용은 증거로서 가치가 없다고 판단해 기각됐다. 기소에 무리가 있었다는 반증이다.

김수임을 사형으로 이끈 13가지 혐의는 다음과 같다.

1. 1946년 9월 이강국을 자신의 집에 은닉시킨 후 베어드 대령 지프로 개성까지 데려다줌으로써 월북을 가능케 함.
2. 1946년 12월부터 1948년 7월까지 이강국의 연락원을 은닉 보호하며, 그를 통해 서신을 수신하고, 이강국에게 다량의 커피, 미제 연초 등의 물자를 제공.

3. 1947년 12월 이강국이 남로당에 보낸 정치자금(일본은행권)을 베어드 대령이 제공한 군용트럭으로 서울에 옮김.

4. 1948년 9월 북한에서 온 남로당원을 자신의 집에 은닉 보호.

5. 1948년 12월 및 1950년 1월 초 남로당 박민호, 김용봉에게 미군철수문제 한국경찰 무장문제에 관한 정보를 제공.

6. 1948년 9월 베어드 대령으로부터 지프 2대를 공짜로 얻어 1949년 7월 남로당 박민호 최만용에게 매도.

7. 1949년 9월 남로당 최만용이 장물고매(臟物故買)한 지프에 대해 자동차 사용허가를 내줌.

8. 1949년 7월 자신의 자동차를 남로당 최만용이 언제든 사용할 수 있도록 함.

9. 1949년 8월 남로당 최만용이 군 수사기관에 체포된 것을 구호 석방하는 자금을 대줌.

10. 1949년 8월 남로당 최만용의 불법무기를 자가에 은닉.

11. 1949년 8월 남로당 박민호에게 자가에서 라디오 1대 미제 무전기 1대를 제공.

12. 1949년 12월 남로당 이용원에게 돈을 빌려주어 적을 이롭게 함.

13. 1949년 12월 남로당 이용원의 불법무기를 자신의 집에 은닉.

김수임은 위와 같은 혐의로 6월28일(베어드 파일 근거) 사형을 당했다. 과연 이것이 사형을 당할 정도로 엄중한 간첩혐의였을까? 베어드 파일과 조명화 감독은 이의를 제기한다.

우선, 1946년 9월 이강국이 월북할 때는 남과 북 모두 정부가 수립되기 전이었다. 한반도가 하나의 국가가 될지 두 개의 국가가 될지 모르는 상태였다. 38선은 당시 미국과 소련의 군사상 분계선일 뿐이었다. 한홍구 성공회대 교수는 “따라서 이강국은 월경죄에 해당하고, 이를 도와준 김수임은 설사 범죄가 성립된다 할지라도 간첩죄가 아니라 범인은닉 도주방조 정도에 해당할 뿐이다. 사형 받을 정도의 혐의는 아니었다”고 주장했다. 그는 또 이강국에게 담배와 커피를 보낸 것이 간첩혐의라 할 수 있는지 의문을 제기했다.

기밀 아닌 기밀

김수임의 혐의 중에서 가장 큰 게 국가기밀을 빼돌려 남로당에 제공했다는 것이다. 그런데 김수임이 베어드로부터 국가기밀을 빼내 북한에 넘겼다면 베어드 역시 처벌을 면할 수 없다. 하지만 베어드 파일은 베어드에 대해 반역행위를 한 증거가 없다고 명시했다. 무엇보다 베어드는 국가기밀을 취급할 위치에 있지 않았다고 돼 있다. 하지 준장을 포함한 많은 미군 장교가 베어드 대령은 미군 철수와 관련된 기밀사안들에 관한 접근권한 자체가 없었다고 증언했다.

기소 사항인 ‘미군 철수 사실’과 ‘한국 경찰 무장’ 문제에 대해서도 베어드 대령은 “1948년 당시 미군 철수에 대해 어떤 정보도 갖고 있지 않았으며 1950년 미 대사관의 한 직원에게서 한국 경찰의 화기를 곤봉으로 대체해야 되지 않느냐는 질문을 받았으나 실행되기 어려운 일이라고 말했다”며 김수임에게 정보를 제공한 사실을 부인했다. 미군 지휘관들도 베어드 대령이 미군철수계획의 전모나 구체적 실행계획을 알 만한 위치에 있지 않았으며, 1948년 9월 철수개시계획이 무산된 이후 1949년 새 계획이 수립됐으나 유사한 정보가 일본에서 출간되는 ‘성조기’에 보도되는 등 충분히 예측 가능한 내용이었다고 증언하고 있다.

김수임은 법정에서 “박민호 등은 미 군정청에서 일을 하고 있어 자신들의 미래와 고용 여부를 걱정했기 때문에 베어드 대령에게 철수 계획에 관하여 물어보았고 그 정보를 친구들과 공유했다”고 진술했다.

기소 내용 중에 6개가 남로당 최만용이란 인물과 관련이 있다. 그는 김수임의 이부(異父)동생으로, 옥인동 19번지에 함께 살면서 미군부대 차량 운전수 노릇을 하고 있었다. 따라서 김수임이 군 수사기관에 체포된 동생을 위해 석방자금을 대주고, 미군에서 나온 지프를 사도록 도와준 것이 간첩행위였는지 의문이다. 또한 그의 집에 불법무기를 은닉했다는 것도 남로당원이었던 최만용이 은닉한 것일 수 있다는 점에서 김수임의 간첩행위로 단정하기엔 무리라고 볼 수 있다.

또한 베어드 파일은 이강국을 월북시키거나 남로당 정치자금을 운반하는 데 미군 차량이 동원된 부분, 군용 지프가 김수임을 통해 남로당으로 흘러들어갔다는 내용 등에 대해 ‘입증할 수 없는 사실’이라고 규정했다. 공산주의 활동을 위해 사용된 라디오와 기타 장비들의 불법적 운용과 관련해서도 베어드는 김수임과 육체적 관계를 갖는 대가로 이를 주는 등의 협약을 했다는 혐의를 부인했고, 미군 감찰관은 증거들이 혐의를 입증하지 못했다고 적고 있다.

지긋지긋했던 고문

이는 기본적으로 용의자의 자백이나 주변 사람들의 증언에 전적으로 의존한 당시 한국의 수사관행과 철저한 물적 증거를 내세우는 미국 관행의 차이에서 비롯된 것이라고도 할 수 있다. 그러나 남북 간의 대립, 갈등이 전쟁으로 발전되는 당시 상황에서 김수임을 거물간첩으로 만듦으로써 반공 이데올로기를 전파하려는 목적으로 조작됐다는 의심을 낳는다고 AP통신은 주장했다.

그 증거로 베어드 파일은 김수임이 고문에 의해 강압적으로 혐의를 시인한 것으로 보고 있다는 점을 들었다. 베어드 파일엔 “김수임으로부터 강압적으로 자백을 받았다는 증거는 없지만, 목격자 증언으로 볼 때 이 문제에 대한 조사가 필요하다”고 되어 있다. 한국 자문단 대표였던 윌리엄 라이트 대령은 ‘김수임의 자백은 자발적인 증언이라고 하더라도 죽음을 늦추기 위해, 목숨을 구하기 위해 자백했을 가능성이 있다’ ‘물고문은 보통이고, 전기 고문에 펜치까지 사용된 지긋지긋한 고문에 더 이상 견딜 수 없었을 것’이라고 증언했다.

AP통신 기자는 당시 검사였던 김태청 변호사에게 “그녀는 고문을 받았는가?”라고 묻자 “내가 아는 것이라곤 법정에서 일어났던 일뿐이다”라고 대답했다고 보도했다.

이와 관련해 김수임 관련 수사드라마를 집필했고 나중에 실화소설도 펴낸 오재호씨는 새로운 사실을 들려주었다.

“사건을 취재하던 중, 당시 수사경찰관으로부터 ‘김수임이 마지막 재판에 자백을 하기 위해 들것에 실려 법정에 들어왔다’는 말을 직접 들었다. 그 정도로 고문을 심하게 당했다는 것이다. 자백을 하지 않으면 또다시 고문실로 끌려갈 것이 두려워 김수임이 결국 모든 걸 포기하지 않았나 싶다.”

재판 절차도 의문으로 남는다. 민간인이었던 그를 군사법정에서, 그것도 3일 동안 연속해서 재판하고 마지막 날 사형을 선고했다. 군에서는 ‘국방경비법’ 33조 간첩이적행위 조항을 적용해 민간인인 그를 재판하는 게 가능하다고 주장했다. 그런데 국방경비법은 법을 공포한 날이 미상으로 되어 있다. 또한 미군정에서 만든 법이었으므로 영문으로 먼저 법을 만든 후 이를 한글로 번역했을 것이다. 따라서 영문으로 된 법령집과 한글로 된 법령집이 똑같이 있어야 함에도 이 법은 영문 법령집에는 없고 한글판에만 있다. 이에 대해 한홍구 교수는 미군정 말기에 법이 제정된 것처럼 조작한 것이라고 주장했다. 이 법에 의해 목숨을 잃은 사람이 김수임을 포함해 1000명에 달했다.

베어드와 이강국

의문은 또 있다. 미 육군성은 베어드 대령을 조사한 후 ‘간첩동조 및 방조혐의’에 대해 무혐의 판결을 내렸지만, ‘한국인 정부와의 스캔들 때문에 미군 명예를 실추시킨 것’에 대해 군사재판에 회부할 것을 권고했다. 그러나 그로부터 한 달이 지나기도 전에 이 파일은 종결사건으로 분류됐다. 이 부분에 대해 AP통신은 ‘누가 이 재판을 저지했고 도대체 왜 그랬던 것일까’ 의문을 제기한다.

이 의문을 풀기 위해선 베어드와 이강국의 관계를 눈여겨봐야 한다. 이강국은 북한에서 열린 재판에서 자신이 미국에 고용된 간첩이었다고 자백한 것으로 되어 있다. 1935년 독일 유학을 마친 후 귀국하는 길에 미국에 들렀다가 미국 정탐부에 포섭됐으며, 김수임을 이용해 1946년 6월 베어드를 만나 협력할 것을 약속했다는 것이다. 또한 “1946년 9월 베어드의 지시로 애국자로 위장하여 북한에 올라가 1948년 5월까지 5차례에 걸쳐 베어드에게 매우 중요한 기밀을 제공했다” “베어드가 내게 ‘김수임을 남로당과 연계해달라’고 해 이승엽을 소개해주었다”고 진술했다. 이강국은 1948년 실각하면서 더 이상 김수임과 연락할 수 없게 됐고, “1948년 8월 이후에 김수임은 이승엽과 연계된 것으로 보인다”고 진술했다.

이게 사실이라면 이강국이 김수임을 통해 남한의 정보를 수집한 것이 아니라, 오히려 베어드가 김수임을 통해 북한 정보를 수집했다는 이야기가 된다. 김수임이 재판에서 최만용과 박민호 등이 남로당원이었지만 동시에 미군정 첩보원이기도 했다고 진술한 것을 보면, 이 주장은 제법 설득력이 있어 보인다.

해방전후사를 전공한 고지수 현대사자료실 연구원에 따르면 당시 미군정에서 대(對)남로당 첩보원들을 두고 있었는데 이런 사실을 모르는 한국 검경에 의해 공산당으로 분류돼 붙잡히는 일이 많았다고 한다. 즉, 국내 검경은 김수임이 미군정의 북한정보원이라는 사실을 모른 채 수사를 하고 구속, 사형까지 끌고 간 것일 수도 있다.

김수임 검거에 결정적 영향을 준 것은 남로당에서 활동하던 양한모(본명 홍민표)가 1949년 전향하면서 남로당 조직을 대거 밀고한 사건이다. 당시 150여 명의 남로당원이 일망타진됐는데, 여기에 김수임이 포함됐다. 김수임 사건 담당검사였던 고(故) 오제도 변호사도 자신의 수기에서 “김수임이 검·경·군 합동수사분실의 수사망에 걸려든 것은 1950년 2월 말이었다”고 회고했다.

이에 대해 조 감독은 “이강국이 미국의 간첩이고, 김수임이 이강국과 베어드의 연결고리가 되려면 베어드는 군 정보 관계자여야 한다. 그런데 당시 한국정보팀을 담당했던 사람은 쉴리 소령이었고, 쉴리 파일에서 한국 관련 정보들이 발견됐다. 베어드 파일에선 어떤 정보도 나오지 않았다. 물론 아직 아무도 열람하지 않은 당시 한국관련 자료와 서류들이 미국 문서보관소엔 쌓여 있다. 거기에서 어떤 자료가 나올지 모르지만, 현재로서는 베어드가 정보 일을 했다는 것은 확인되지 않았다”며 조심스럽게 이강국과 베어드의 연관설을 부인했다.

JACK와 CIC

이강국이 베어드에게 고용된 정보원(또는 간첩)은 아니라고 할지라도 미국에 고용된 간첩 혹은 정보원이었다는 기록이 최근 발견됐다. AP통신은 1956년 작성된 미 육군 극비자료 프로필에 이강국이 CIA에 의해 ‘JACK(한국합동공작단, Joint Activities Commission, Korea)’에 고용됐으며, 실제로 1953년 6·25전쟁 휴전 직전에 ‘미군 첩자’로 북한에서 처형됐다고 적혀 있다고 보도했다. 그러나 이강국이 실제 미군과 연결돼 있었는지에 대해서는 미스터리로 남아 있다고 부연했다. 이 파일엔 “1953년 11월 보고에 따르면 이강국은 일본 동경도 차기구 내 JACK에 고용된 것이 확인됐다(A report of nov 53. stated that Yi was employed by JACK in Chagi-ku, Tokyo-to, Japan)”고 돼 있다. 여기엔 고용됐다고만 되어 있을 뿐 언제 어떻게 되었고, 어떤 활동을 했다는 언급은 없다.

이강국이 미국 간첩일 수 있다는 근거는 2001년 발견된 문서에서도 발견된 바 있다. 여기엔 이강국, 임화, 이름이 기록되지 않은 남로당 선전부장 등이 미군정 산하 주한미군방첩대(CIC·Counter Intelligence Corps)에 포섭된 정보원이라고 돼 있다.

물론 이 기록들에 의심의 여지는 있다. CIA는 1947년 7월에 설립됐다. 따라서 산하조직인 JACK 역시 그 이후에 만들어졌을 것이다. 이 기구는 6·25전쟁 시기에 활약했고, CIA 일본지국의 지휘를 받았다. 그러나 이강국이 월북한 것은 1946년 9월이었다. 시기적으로 맞지 않는 부분이 있다.

또한 CIC와 이강국의 관계도 당시 정황에서 ‘간첩’으로 단정짓기는 어렵다. CIA의 전신인 OSS와 협력했던 아시아공산주의자 명단엔 마오쩌둥, 호치민 등의 포함돼 있을 정도로 당시 동아시아 공산주의자들은 미국과 긴밀한 관계를 구축했었다. 특히 남로당 고위급 인사였던 이강국이 미군정과 비선(秘線)을 가지고 있는 것 자체가 특기할 만한 일로 보기는 힘들다는 게 학계의 이야기다.

조명화 감독은 이강국의 간첩혐의 의혹에 대해 이런 추측을 내놓았다.

“이강국이 미국의 도움을 받으려 했다면 이유는 하나일 것이다. 당시 지식인들이 원하는 국가는 통일국가였다. 그런데 북한은 이미 김일성이 정권을 잡고 있었다. 그런 상태에선 남한만의 정부를 만들 수밖에 없다. 따라서 사회주의자인 이강국으로서는 투쟁지역이 남한이 아닌 북한이 돼야 한다. 이강국은 북한에서 사회주의 투쟁을 하기 위해 북한에 안착할 방법을 찾았고, 미국의 도움을 얻었을지도 모른다. 아무튼 이강국이 미군에 고용된 간첩이든, 미군과 협력관계였든 미군과 연계돼 있었다면 김수임에게 간첩죄는 성립되지 않는다.”

치열한 삶을 산 여자

김수임이 간첩이냐 아니냐를 떠나 한 가지 의문이 생긴다. 김수임은 이념에 무지한 채 한 남자에 목숨을 걸었거나, 아무 것도 모르고 두 남자에게 이용당한 무지하기만 한 여성이었느냐는 것이다.

모윤숙의 에세이에 보면 모윤숙과 이강국이 ‘이승만을 어떻게 볼 것인가’를 놓고 격론을 벌이는 장면이 나온다. 여기서 김수임은 이승만을 비판하며 “자본주의자인 이승만이가 미국에 한국을 팔아먹을지도 모른다”고 단호하게 말한다. 또한 재판 최후진술에서 “나로서는 일생일대의 잊지 못할 사랑이었다. 나를 위해 힘써준 분이 여럿 있고 애인도 있지만, 그분들을 위해 나로서는 당연한 일을 했고 후회하지 않는다. 죽기 전에 감사하다는 말을 한다”고 담담하게 말했다.

자기 생각을 갖고 자기 신념대로 행동했다는 이야기다. 조 감독은 “지금까지 김수임에 대한 시각이 반공 이데올로기, 또는 ‘버림받은 여인’이라는 남성중심 관점에 머물러 있었다”며 “김수임은 ‘일과 사랑’을 통해 시대를 치열하게 살다 간 인물이었다”라고 평가했다. 그는 김수임을 바로 알기 위해서는 시대를 이해해야 한다고 주장한다.

“1946년 미군이 여론조사를 했는데, 남한 주민 77%가 사회주의 국가 건설을 바랐다. 이들이 말한 사회주의는 지금의 사회주의와는 다르다. 제국주의와 봉건제도에 반대되는 개념으로 사회주의를 생각한 것이다. 일제 강점기 때 일제에 반대하는 운동을 주로 했던 게 사회주의자들이었다. 국민은 자유민주주의가 뭔지도 모를 때였다. 김수임도 일제에 반대하고, 봉건제도에 반대하는 의지가 강했다. 그게 사회주의 사상으로 표출된 것이다.”

그러나 미 군정청의 하지 준장은 그 같은 여론조사 결과의 이면을 무시했다. 사회주의자들을 탄압하고 친일파 관료를 등용했다. 이것이 바로 김수임이 빠져든 역사의 함정이요 딜레마였다고 조 감독은 말했다.

진실과 화해

김수임 사건은 현재도 역사의 미제(未濟)로 남아 있다. 몇몇 학자나 아들인 김원일 교수, 조명화 감독 등 개인들의 노력만으로는 진실을 밝혀내기엔 한계가 많다. 이런 사건의 진실을 밝히라고 만든 게 ‘진실·화해를 위한 과거사 정리위원회’다. 그런데 2005년 12월 출범한 진실·화해위원회는 출범 직후 1년 동안만 사건 신청을 받아 지금은 그 기간이 지났다.

김원일 교수는 당시 이런 사실을 몰랐다고 한다. 그는 “이제라도 아들 자격으로 진정서를 제출하는 게 어떠냐”는 한 언론사의 e메일 질문에 “역사와 화해하고 역사를 바로잡는 것은 그 의무를 위탁받은 위원회의 역사적 과제이지 유가족이나 친지의 개인적 과제는 아니라고 본다. 위원회의 판단과 역량을 믿고 지켜보는 것이 내가 서 있어야 할 가장 적절한 자리”라며 자신이 나설 계획이 없음을 분명히 했다.

이에 대해 진실화해위원회 측은 “신청기간이 지났기 때문에 이 사건에 대한 진정을 받거나 하는 것은 고려대상이 아니다. 다만, 최종결정기구인 전원위원회에서 직권조사하기로 결정하면 조사에 착수할 수는 있다. 현재까지는 그런 결정이 내려지거나, 논의할 계획이 서 있지는 않다”고 밝혔다.

Q & A on TRC

Q1. It seems that the mission of the Truth and Reconciliation Commission of Korea is quite different than previous transitional justice efforts (such as the Presidential Truth Committee on Suspicious Deaths), due in large part to the emphasis on reconciliation.
A1. The correct title for the commission mentioned in the parenthesis above is “the Presidential Commission on Suspicious Deaths in the Military.” As indicated in its name, there’s a clear distinction in its scope of investigation compared to our commission. It only deals with cases in the military, while our commission deals with overall human rights abuses beginning during Korea’s democratization process to the end of the authoritarian regime of 1992. Additionally, there was also a commission named the Presidential Truth Commission on Suspicious Deaths, which ceased its investigative activities on June 30, 2004. (Please see our website at http://jinsil.go.kr/English/index.asp On the bottom right side, you will find the button titled, "Former Truth Commissions.") The other commissions in Korea involved in related truth-finding work investigate distinctive areas covering either different time periods or different sectors of society. Although there are several other past-related commissions in Korea, they are quite different from our commission in terms of their mission and objectives. We believe truth-finding work is an initial step to reach a possible reconciliation. Without it, the achievement of reconciliation would be practically impossible. All of the above-mentioned commissions are dedicated to uncovering the truth from past wrongdoings. In this sense, they share the same qualifications to investigate cases for reconciliation, which is the fundamental goal of all truth-finding activities.
Q2. To what extent is reconciliation a goal of the TRCK? and what mandate does the TRCK have?
A2. The Truth and Reconciliation Commission Korea does not have any authority to prosecute or provide economic compensation to victims, but it has some rights to investigate filed cases, and submit recommendations to the concerned governmental organizations. The commission must also submit investigation reports to the President and the Parliament twice a year, and afterwards, report its findings to anybody interested. As commented above, we believe truth-finding is the first step toward reconciliation. Although the commission doesn’t have direct authority to prosecute, petitioners are still empowered by using the commission’s findings for judicial settlements; often resulting in some kind of compensation.
Q3. How is reconciliation pursued (Truth-telling? Apologies from perpetrators? Reparations from the courts?)?
A3. You understood correctly. Measures below are used to seek reconciliation between perpetrators and victims. 1. Listening to the victims' narratives and truth-telling through commission’s investigative reports, 2. Recommendations to public authorities to give formal apologies to victims, 3. Recommendations of new retrials to the court and judicial settlements, 4. Restoration of honor to the victims by submitting recommendations to the Korean government and conducting memorial services, etc. 5. Recommendations for revisions to modern history by accepting the newly-verified truth of the commission.
Q4. I have read the TRCK's 2008 brochure, which does a good job at laying out the framework of reconciliation. I would just like to have some additional information to better understand the activities of the TRC, government, and civil society in terms of reconciliation efforts. I am trying to pin down if the TRCK is a turning point in transitional justice in Korea in regard to reconciliation. Could you direct me to previous efforts at reconciliation in South Korea (in the post-military regime period)?
A4. The investigative scope of the Truth and Reconciliation Commission Korea largely covers three different areas: Overseas independence movements during the Japanese occupation, mass civilian sacrifices before and during the Korean War, and human rights abuses during Korea’s democratization. There were previous efforts to seek truth and settle past wrongdoings. In 1948, a special law was passed to prosecute Japanese collaborators during Japan’s colonial regime, yet it was annulled in 1951; this law is largely acknowledged as unsuccessful and a large number of those accused of collaborating with the Japanese occupational government were never brought to trial. Secondly, in the political vacuum after the fall of Syngman Rhee in 1960, the victims' families of the Korean War protested to demand settlement for their grievances. The Korean National Assembly responded by investigating the massacres. However, after the May 16 Military Coup of 1961, the military oppressed those activities and abolished further investigation. Many even prospered during the U.S. occupational government, the military dictatorships, and to this today.
Although, during the period of military dictatorships in Korea, little attention was given to the truth-finding work in the governmental arena, there were constant movements among civil groups and the public dedicated to rectifying past incidents; the Gwangju Democratization Movement in 1980, the Student Demonstration at Konkuk University in 1987, etc. These are good examples of how people and civil groups continued to pursue the truth even under severe authoritarian repression. In 1995, a valuable lesson was proven with the prosecution and sentencing of two former authoritarian rulers of Korea, Chun Doo-hwan and Roh Tae-woo; even successful coups can be punished. The laws for rectifying the past have been passed under the Korea's government under Kim Dae-jung (1998-2003). The systematically implemented truth-finding work at the governmental level only began when former president Roh Moo-hyun took office.
Q5. What is the level of truth that the TRCK is trying to achieve? Would you say it is more of a narrative-truth or legal truth (beyond a reasonable doubt)?
A5. Could you define “narrative-truth” and “legal truth”?
Q6.I saw on the website that an MOU was recently signed with Chile in the area of transitional justice. Congratulations! What other nations has the TRCK worked with or looked to for guidance? Are there any other nations that the TRCK or Korean government has formal agreements with in the realm of transitional justice?
A6. Many other countries also share similar stories that Korea has, and thus leaving responsibilities of settling the past to all. Not to mention the countries involved in the I and II World Wars, there still are plenty of countries out there to look for exemplary stories in regard to truth-finding works. Among those, we can easily look to cases from South Africa, Chile, Argentina, Peru, Rwanda, Cambodia, Indonesia, Spain, even Canada and the U.S. Our commission tries to build an international alliance in relations to make truth-finding process soother for respective nation. Currently, we’re working toward developing an MOU with Argentineans.
Q7. In terms of the proposals for a special pardon, reinstatement, or reduction of penalties, how often are these proposals honored and/or accepted?
A7. The TRCK is only empowered with submitting recommendations in accordance with its findings.
Q8. How does the TRCK pursue reconciliation between offenders, victims, and victims’ families? Was this a part of the mandate of past truth commissions in Korea?
A8. Through recommendations, the TRCK has assisted to bring about formal apologies from the government, retrials on previous judicial cases, documentation of historical records, memorial services, and etc.
Q9. What are some examples of legal and political reconciliation measures for offenders? What are some examples of measures for national reconciliation and integration?
A9. After completing each investigation, the TRCK concludes whether the truth was found or not. Every investigation report includes recommendations to the government (the government is ultimately the responsible party for most of the cases filed at the TRCK). Common recommendation measures include official apologies from the government, retrials, memorial services, and education on human rights and sustainable peace, etc.
Q10. In your opinion, would you say that the State has shown respect for TRCK proposals and decisions to this point? Are there any guarantees of this?
A10. To implement its recommendations, the TRCK submits its findings to the Recommendations Follow-Up Board of the TRCK, which is under the Ministry of Public Administration and Security. As of May 2008, a total of 49 findings from the TRCK were submitted to the Recommendations Follow-Up Board of the TRCK.
Q11. Has the Reconciliation Foundation been established yet? If so, what services and exhibitions have been held?
A11. The Reconciliation Foundation has not been established yet. The TRCK is currently working towards this, and expects to see the draft by March 2009.
Q12. What is the role of the Reconciliation Commission? Is there any information as to the scope, power, and organization of this proposed body?
A12. The Reconciliation Commission was constituted on June 19, 2007, in order to deliberate and resolve measurements concerning restoring honor to victims, issuing special pardons for the victims, recommending reinstatements, preventing similar cases from reoccurring, and etc.
Q13. Some argue proceeding truth-finding works only disrupts the social unification and deepens the conflicts between parties, which do not consent one another.
Main purpose of truth-finding task includes healing the pains from wrongly written past through unearthing truth, which has been covered and eventually, and eventually attempting reconciliation between perpetrators and victims.
According to the survey conducted by SISA JOURNAL, a monthly political magazine in South Korea, in February, 2008, 61.8% of total respondents said they felt necessary the truth-finding works to be completed, thereby setting a better standard for the future. 29.4% responded it only produces social disorientation and is not necessary.

Q14. Recently, there seem to be an attempt to combine the existing commissions involved in truth-finding works, and merged to the TRC. Where the TRC stands and what would be expected problems if so?
January 21, 2008, the Grand National Party of Korea submitted a draft outlining a merge of several truth-finding commissions into the TRC.
There are a few expected problems in this regards.
First, there are distinctions between the TRC’s mandates and the mandates of those 9 truth-finding commissions. The TRC extensively deals with investigations to find truth by a group, while the other commissions are rather focus on individual cases of reparation, building memorial monuments, restoring honors of the dead.
Second, if the merge proceeds, it is expected that petitioners at the TRC would ask for economic compensation and/or memorial services/moments which were promised in the precedent commissions, which may cause great confusion in maintaining consistency for the TRC.
Third, the TRC is already overloaded with a total of 10,954 petitions; only 29% thereof, 3,182 were concluded, and its mandate to be expired in 2010. Adding more cases to the TRC without guaranteeing adequate resources will apparently only increase improbability of tasks of the TRC being completed within the designated term, by 2010.
Fourth, recently the Board of Audit and Inspection of the Republic of Korea released it is necessary to introduce a bill or similar sorts of sufficient legislatorial prerequisites to implement the above-mentioned draft.
